HomeMy WebLinkAboutORD 557BILL NO* 7 ORDINANCE -NO, 567 By HINDS e *iwh*** AN ORDINANCE AMENDING ORDINANCE NO* 413 OF THE CITY OF CALDWELL ENTITLED "AN ORDINANCE PROVIDING FOR THE REGULATION OF TRFIC ON THE STREETS, AVENUES, ALLEYS AND PUBLIC PLACES OF THE CITY OF CALDWELL, PROVIDING PENALTIES FOR THE VIOLATION THEREOF AND REPEALING ORDINANCE NOIS, 2552 277 AND 360 AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH" BY AMENDING SECTION 14 AND BY AMENDING SECTION 37A THEREOF AS PASSED AND AMENDED IN ORDINANCE NO. 444 OF THE CITY OF CALDWELL, AND BY ADDING TEN NEW SECTIONS TO BE ;XNOWN AS SEC- TIONS 44, 45, 46 46a, 47 48, 49 50 51 AND 52, REGULATING TRAFFIC AT STREET INTERSECTIONS WHERE INTERMITTENT DIFFERENT LIGHTS ARE PLACED AND EXPOSED AND BY REGULATING TRAFFIC IN THE ALLEYS OF THE CITY OF CALDWELL, REGULATING PARK- ING AND PARKING SPACES IN FRONT OF THEATRES AND IN FRONT OF PRIVATE RUNWAYS AND PROHIBITING THE PARKING OF MOTOR VEHICLES, AUTOMOBILES, TRUCKS AND TRAILERS ON THE STREETS AND.ALLEYS OF THE CITY OF CALDWELL FOR A LONGER PERIOD THAN TWENTY FOUR HOURS, REGULATING THE LOADING AND UNLOADING OF CHILDREN TO-AND FROM SCHOOL,BUSES, REGULATING TRAFFIC UPON THE STREETS OF THE CITY OF CALDWELL UPON'THE APPROACH OF THE'POLICE AND FIRE APPARAT- USES AND DURING FIRES WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL, REGULATING THUMBING AND SIGNALING FOR AIDES BY HITCH - HIKERS, REGULATING THE CARRYING OF CARCASSES OF DEAD ANIMALS THROUGH THE CITY OF,CALDWELL AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANC& IN CONFLICT HEREWITH. ***iH6* BE IT ORDAINED by the Mayor and Council of the City of,Caldwell,.Canyon County Idaho= Section I. That Section 14 of Ordinance No. 413 of the City of Caldwell and Section 37A, of Ordinance Noe 413 of the City of Caldwell as amended by Ordinance NO 444, entitled; age 1. "An Ordinance providing for the regulating of traffic on the streets, avenues, alleya and public places of the City of.Caldwell provid- ing penalties for the violation thereof and repealing Ordinance No's. 255*0 277 and 360 and all other Ordinances or parts of Ordinances in conflict herewith." be, and the same are, hereby amended to read as follows: "Section 14. Every person operating a motor vehicle in the public streets or alleys of the City of Caldwell shall drive the same in a careful and prudent manner and not to exceed thirty miles per hour along the streets, and not to exceed twenty miles per hour along the alleys of the City of Caldwell except that along Chicago Street between Kimball Avenue and Twelfth Avenue the speed shall not exceed twenty -five miles per hour„ and also except that along the following streets the speed shall not exceed twenty miles per hour, to -wit; Cleveland Boulevard between 12th Avenue and 4th Avenue; Arthur Street between 12th Avenue and 5th Avenue; Kimball Avenue between Chicago Street and Cleveland Boulevard; Blain Street between 12th Avenue and 3rd Avenue; Seventh Avenue between Blain Street and Cleveland Boulevard; 6th Avenue between Blain Street and Cleveland Boulevard; Blaine. Street between 12th Avenue and 7t3a Avenue; 5th Avenue between Albany`Street and Cleveland Boulevard; Aven Street between Cleveland Boulevard and Blain Street; Albany Street between 4th Avenue and 12th Avenue; PROVIDED that on streets of the City of Caldwell where there are school crossings the speed shall not exceed twenty miles per hour and at places where the school patrol has placed re- movable stop signs all drivers of motor vehicles shall observe the stop signs and shall observe the traffic signal given by the patrol boys or patrol officers. That at all intersec- tions where stop signs are placed the drivers of motor vehicles shall stop before entering such intersection," Page 2 0 ` "Seetion Parking on the first or curb line shall be permitted between the hours of 8 o'clock A. M. and 6 o'clock P. M, for a period of not more than one and one -half hours on the following streets and within the following area of the City of Caldwell, to -wit: Main Street from 6th Avenue to 9th Avenue; Arthur Street from 7th Avenue to 9th ,Avenue; 7th Avenue between Main Street.and Arthur Street; Kimball Avenue between the alley north of Main Street and paralleling the railroad tract and Blaine Street," Section II, That said Ordinance No, 413, Gntitled: ` "An Ordinance providing for the regulation of traffic on the streets, avenues, alleys and public places of the City of Caldwell, provid- ing penalties for the violation thereof and repealing Ordinance No's, 255, 277 and S60 and all other Ordinances and parts of Ordinances in conflict herewith," be, and the same,is, hereby amended by adding ten sections to be known as Section 44, Section 45, Section 46,E Section 46a, Section 47, Section 48, Section 49, Section 50, Section 51 and Section 52 to -wits "Section 44z That the Chief of Police, as directed by the Mayor and Council, of the City of Caldwell shall in- stall signal lights for the controlling of traffic at in- tersections of the streets and alleys of the City of Cald- well,, Idaho, That such signal light shall be of a standard variety with alternating red and green lights except that when deemed advisable a standard variety of blinking lights may be used." "Section 45: No person shall drive or move a vehicle Page 3 . through or walk across any intersection of a street or alley against a light showing red but all such traffic shall move at right angles with the ray of the red light and all vehicles shall be driven or moved and all pedest- rians and vehicles shall proceed parallel with the ray of green lights and that at all intersections where blinking lights are used such traffic shall stop before entering an intersection before a red blinking light and shall drive slowly and carefully when entering an intersection where a yellow or green blinking light is used at the intersection, and that at all intersections where such signal lights are not exposed and at all times when the same shall not be in operation the usual stop signal otherwise posted or in opera- tion at such intersection shall be observed by all persons driving or operating such vehicles before entering such in- tersection against such stop sign PROVIDED, that nothing herein shall be construed to prevent the operator of a motor vehicle or other vehicles to make the right -hand or left -hand turn wren proceeding with the green light, and PROVIDED FURTHER that the pedestrian shall have the right - of-way to proceed first across the intersection when pro- ceeding with the green light in his favor." "Section 46: That the traffic in the alley between Blaine Street and Main Street shall enter said alley at 7th Avenue and move in a southeasterly direction to Kimball Avenue and no vehicle shall enter said alley or move in said alley in any other direction, and all vehicles leaving said alley shall make a right -hand turn and no persons driving Page 4 • such vehicles leaving said alleys shall make a left -hand turn in so doing." "Section 46 -a. That the police of the City of Cald- well are hereby authorized from time to time to establish loading zones, for loading and unloading merchandise in the City of Caldwell and that it shall be unlawful for any per- son, firm or corporation to occupy said loading zone for a period longer than five minutes at one time." "Section 47; Spaces in front of the theatres and picture shows may be used for parking automobiles and other vehicles, unless otherwise prohibited, at all times during the day when no performance is being held at such theatre or such picture show and when persons are not gathering in i going to or coming out of and leaving the said theatre. It shall be unlawful for any person to park any vehicle in the space in front of any theatre during the time people are gathering and going to such theatre or when such theatre is open for performance, during the performance or when people are coming out of and leaving such theatre, PROVIDED, that bicycles may be parked in places to be marked off by the Police of the City of Caldwell on either side of the entrance of said theatre just adjacent to but outside of the curb line in racks provided for that purpose." "Section 48; No person shall drive a vehicle past a school bus loading or unloading school children on -the way to or from the public schools of the City of Caldwell That all school buses or vehicles transporting school children Page- 5 . to and from school shall draw up and stop along the curb line of the school grounds where such children are being loaded or unloaded, so that such children shall enter or leave the said bus or other vehicle on the right-hand side thereof when the driver is looking toward the engine or the front end of such bus or vehicle., and no child shall be loaded or unloaded to or from the school bus arriving at or leaving such school except at the school groundse" "Section 49; That upon the approach of any Police or Fire Department vehicle or ambulance giving audible signal by bell, siren or exhaust whistle, or any other device, the driver of every other vehicle shall immediately drive the same to.a position as near as possible and parallel to the right -hhnd edge or curb of the highway clear of any intersection of highways, and shall stop and rems.14 in such a position unless otherwise directed by a Police traffic Officer until the Police or Fire Department ambulance or vehicle shall have passed and no pedestrian shall cross the intersection of a street along which a Police or Fire De- partment vehicle giving such signal is traveling, until the same shall have passed the intersection "It shall be unlawful for a driver of any vehicle other than one on official business to follow any Fire apparatus or Police vehicle traveling in response to a fire ].arm closer than five hundred feet or to drive into or park such vehicle within a distance of five hundred feet where such fire apparatus has stopped in answer to a fire alarm* wx n M1 zLm and in no even' shal]. park such Vvehlcie between the fare Page 6 e apparatus and the two nearest water hydrants. That at all time such fire apparatus of the City of Caldwell and Police cars shall have the right -of -way going to and returning from any fire, and in no event shall any car or vehicle be parked a- in any way to interfer with the free operation of such Police } vehicle or fire apparatus * " "Section 50; That it shall be unlawful for any person or hW h -hiker thumbing or signaling to secure a ride from persons driving or riding in motor vehicles to step out into the line of traffic while thumbing or signaling for such ride, and no person, while thumbing or signaling for a ride, shall stand further out into the street than the curb or curb line of the streets of the City of Caldwell *" ttSection 51; That it shall be unlawful for any person firm or corporation to haul, cart or transport carcasses of any dead animals, other than edible products, through any of the streets, business or residential sections, of the City of Caldwell or alleys of the City of Caldwell, except as may be otherwise designated by the Chief of Police by authority of the Mayor and Council of the City of Caldwell." "Section 52: It shall be unlawful for any person firm or corporation to park a car or trailer or motor vehicle of any kind across any private drive -way so as to interfer with the ingress and egress of said private drive -way, and it shall be unlawful for any person, firm or corporation to park any motor vehicle, automobile, truck or trailer and permit the same to remain upon the streets or alleys of the City of Caldwell for a longer period than twenty -four hours Page 7 . without the same having been moved, PROVIDED that this sec- tion shall not effect,, impair or abridge any of the Ordinances of the City of Caldwell providing for a shorter petiod of time for parking motor vehicles, automobiles, trucks or trailers upon the streets or alleys in the business section of the City of Caldwell and is intended to control in all instances where parking such motor vehicles, automobiles, trucks or trailers were otherwise not provided for by the Ordinances of the City of Caldwell." Section III. All Ordinances or parts of Ordinances in conflict with this Ordinance be, and the same are, hereby repealed and this Ordinance shall be construed as a part of and in harmony with and in aid of all the other traffic Ordinances of the City of Caldwell® All violators of this Ordinance shall be punished as provided by Ordinance No* 413 of the City of Caldwell, Idaho PASSED by the Council of the City of Caldwell, this day of , 1e APPROVED by the Mayor of the City of Caldwell, this _.Za day of ATTEST: Mayor@ 1 • City Clerk. i
