THE- - g y�g° m w CITY OF CALDWELL., AND PROHIBITING THE PLANTING OF CERTAIN SPECIES OF TREES IN THE CITY OF CALDWELL, PROVIDING FOR SPEC PER— NITS TO PLATT, REMOVE OR PRUNE TREES AND SHRUBBERY WITHIN THE CITY OF CAL3WELL ALL UNDER THE SUPER- VISION OF THE SUPERINTENDW OF PARKS AND THE PARK COMMISSION, PROVIDING.FOR BUDGETING THE EXPENSES OF THE PARK COMMISSION, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE AND PROVIDING FOR A PENALTY IN CASE OF VIOLATION` TO PROVIDE FOR SEVEN MEMBERS OF THE PARS COMMISSION INSTEAD OF FIVE AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL, of the City of Caldwell, Canyon County, Idaho3 SECTION I• That Section I of Ordinance No. 545 of the City of Caldwell, entitled "AN ORDINANCE CO- ORDINATING THE PARKS AND PARKING SYSTEMS CREATING A PARK COMMISSION OF THE CITY OF CALDWELL, PRESCRIBING ITS DUTIES, POITIERS AND AUTHORITIES, AND REGULATING THE PLANTING OF TREES, FLOWERS AND SHRUBBERY ALONG THE STREETS AND ALLEYS OF THE CITY OF CALDWELL, AND PROHIBIT- ING THE PLANTING OF CERTAIN SPECIES OF TREES IN THE CITY OF CALDWELL PROVIDING FOR SPECIAL PERMITS TO PLANT, REMOVE OR PRUNE TREES AND SHRUBBERY WITHIN THE CITY OF CAIDWELL, ALL UNDER THE SUPERVISION OF THE SUPERINTENDANT OF PARKS AND THE -1- PARK COMMISSION, PROVIDING FOR BUDGETING THE EXPENSES OF THE PARK COMMISSION, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE RND PROVIDING FORA PENALTY IN CASE OF VIOLATION ". be and the same is amended to read as follows: "S:ECTION I. Realizing that proper planting and cultivating trees; Shrubbery and flowers is easan.tial to the beauty of the City of Caldwell, and realizing the necessity of a regular method of planting trees, shurbbery and flowers in the parking systems and play- grounds and along the parkings adjacent to the streets and alleys of the City of Caldwell, "NOW, THEREFORE, there is hereby established a com- mission to be known as `CALDWELL PARK COMMISSION ", con - sisting of seven (7) members who shall be appointed by the Mayor and eonfirmed by the City Council, and who shall hold office for a term of four (4) years, except- ing that two (2) of the members shall be appointed from among the Council of the City of Caldwell, whose term of office on this Board shall be eo- extensive withTkI'h of office gs City Councilman. At the time the first members are appointed the Mayor shall designate three (3) citizens at large from the City of Caldwell who shall hold office until the first Monday of May, 1939, or until their successors are appointed by the Mayor and approved by the Council, and two (2) citizens at large from the City of Caldwell who shall hold office until the first Monday of May, 1941 or until their successors are ap- pointed by the Mayor and approved by the Council. That, thereafter, all citizens appointed at large shall hold -2- their office for a term of four (4) years, All vacancies in the Board, by reason of removal, resignation or death, shall be replaced by the Mayor of the City of Caldwell, and all such vacancies shall be filled by appointment in the same manner of appointment as originally made for the unexpiring term of the person whose term had 'ended, either by reason of removal, resignation or by'death. "That the said Commission shall meet on the first Tuesday of June of each year and appoint one of its number as Chairman and one of its number as Vice- Chairman who may assume the duties of Chairman in the absence of the Chair- man of the Board and shall also choose from among its nu - ber one (1) person who shall act as Secretary of the Board, who shall constitute the officers of the Board and shall retain their office for a term of one (1) year or until their successors have been elected and qualified." SECTION II. A11 Ordinances or parts of Ordinances in conflict wilth. this Ordinance are hereby repealed. PASSED by the Council, this 7th day of February, 1938.
