and the same are hereby established to a slope of one (1) to one
(1), except as hereinafter provided, and that the top of said
banks shall be at least eight (8) Feet above the bed of the stream;
and that the over -all width of said stream from the outer edge of
the banks on each side is hereby declared to 'be seventy -six (76)
feet; and that the sAid centerline be and the sane is hereby es-
tablished on the course and distance, to- wit

the Northeast Corner of Block 3 in the Calloway Addition

SECTION 29 That persons owning property along, the banks
of the stream s if they so desire, may rip -rap the sane with stone

on a slope of one to one {l), or the owners of the adjacent
property, if they so desire, may construct permanent concrete per-
pendicular walls along tho'said Creek, and all such walls shall be
supported by sufficient footing, bases and foundation.
That the bases of such walls shall extend at least
three (3) feet below the scour line of said streamp and before such
rip-rap and walls shall be instkUtdd a permit shall be secured by
the property owner from the building inspector and City Engineer of
the City of Caldwell.
SECTION 3# THAT all buildings erected or placed along
or over the said Creek shall leave thirty -three (33) feet lateral
clear water course between the walls and perpetual clearance between
the bed of the stream and the lowest point of such building or striae-
ture of eight (8) feet. Walls of such buildings shall comply with
the ordinances of the City of Caldwell in. all ; respects, and shall
be of substance, size, base. and footing satisfactory to,the City
Engineer and the Building Inspector of the City of Caldwell.
SECTION 4. No bridges shall be erected or constructed
over said Creek except that the same shall leave a lateral water
course clearance of thirty -three (33) feet between the walls and a
perpetual water course clearance above the bed of the stream of a fight

material and substance, size, base and footing as may be prescribed

by the City. Engineer of the City of Caldwell, Canyon County, Idaho
SECTION 5. That no rubbish, debris or waste material
or substance of any kind, shall be deposited in the said Creek or
along its banks, and the banks. of the said Creek shall be kept; free
of foreign substances, trees,'willows or shrubbery., except as may be
permitted by the Parking Co+.iss'ion of the City of Caldwell for the
