Section , One:
Realizing that'' proper planting and oultivRting
trees, shrubbery end flowers is essential to the beauty of
the City of Caldwell, and realizing, the necessity of a reg-
ular method of - -ol.anting trees, shrubbery and flowers In
the parking system and play - grounds and along; the parks
adjacent to the streets': and alleys of the City of Caldwell,

a terra of four years except , that one of the members shall
be appointed from ampng,the Counc:1_l of the City of Cal.d ioll,,
whose tens of office on this Board shall be coextensive writh
his term of office as City Younoilman. At the time the first
members are appointed the Mayor shall designate two citizens
at large from the City of Caldwell who shall hold office
for two years, and two citizens at large from the City� of
Caldwell who shall hold office for a term of four years.
That thereafter all citizens appointed at lame shall hold
- their office for a term of four years All vacancies in

,, he .board by reason of removal, resign��t7or� or death shall
be replaced b;r the Tiayor of the City of Caldwell and such
vacancies shall be filled by appointment in the sane manner
as appoint or orig ianally made for the une,xpiring term of
the person whose" tern had ended by reason of removal, res-
ignation or d oath.
That said Commission shall meet on the first
Tuesday of June of e ach year and appoint one of its number
as Chairman and one of its number as Vice - Chairman who may
assume the duties of Chairman in the absence of the Chair-
Ilan of t he Board and ,hall also o oose from among its number
one person who shah._ act as Secretary of the Board, who
shall constitute tie officers of the Board and shall regain
their office for a term of one year or until their successors
have been elected and qualified.
Section Two
That the said Board shall have general super-
vision of the nlanting of trees, shrubbery and flowers in
the parks and lay- around and along the pa.rki.ng system along
the streets and alleys of the City of Caldwell, and shall
have the general supervision of planting, pruning, cutting
and removing trees, shrubbery and flowers from the said
public parks, play - grounds, and the parking s along;
the streets and alleys of the City of Caldwell 'That no

person shall plant any trees, shrubbery or flowers, or
prune, out or remove any trees, shrubbery or flowers from
any of the public parks and play- ground on the parking
system along the streets a "ihd "all,eys of the City of Cold-
well, not in conformity with general rules 'therefor es-
tablished by the Commaission and approved by the Mayor.

to the Caldwell Park Comiss'ion of the City of Caldwell,
and securing `a special permit therefor.
Section Three:
That the said Park Commission shall with
the approval of the Mayor and Council make and publish
such rules And regulations as may by them seem proper for
the planting of trees, ebbubbery and flowers and the prun-
ing, cutting, and removing of the same within the public
parks and play - grounds and along, the parking system along
the streets and alleys of the City of Caldwell*.
Section Four;
Application for special permit, not in con-
formity with the general rules, shall: be filed with the Park
Commission in writing with the general statements of the
facts upon which such applicatIon for special permit is
based. And such applicant shall pay to the Secretary of the
Park Commission a filing fee in the sum of ten and No/'100
(010.,00) dollars. The'6ecretary of said Park COMIssion shall
thereupon publish a Notice of the time and place of hearing of
said application in the official newspaper of the City of Cald-
well at Least ten dyys before such hearing. The hearing upon
such application shall be public and any person interested
may appear in favor of such a°ppl.ication or protest a ainst
the seme.
pon such hearing the Board; within ten (10)
days thereafter, shall. snake its finding in writing and make
an order thereof approving modifying or denying such
apy)lication.
Section: Five:
Any person or persons dissatisfied with the
findinS and order of said Commission may appeal- to the Mayor
and. City Council by serving a Notice upon the Secretary of
the said Parking Commission stating that he appeals From the
finding and order of said Pare Conmissior to the Hayor and
Council, and filing said Notice of Appeal with the Secretary
of the Palk Commission Boarde
That upon serving and filing said Notice the
Secretary of said Board shall transmit said Notice end all
papers in connection with the said application to and file
the same with the City Clerk. � aubli'a hegrinz on said
petition may be had anew before the Mayor and City Council
at any regular or special meeting; called for the purpose„
The finding; and decision of Mayor and Council. in respect
to said application either denying, modifying or approving
the same shall be final*
Section Sic;
Any fees paid into the Secretary of the Board
may be used for the publication of Notices herein provided for
and for the purchase of supplies necessary for carrying; out

the purpose of the Board and any moneys remaining in the
hands of the Board on the last day of April of each year
shall be paid to the Clerk of the City of Caldwell, and
shall be deposited in the general funds of the City of
Caldwell
Section Seven:
Any person violating the terns of this Ordin-
ance shall be deemed guilty of a misdemeanor and punished by
a fine not to exceed one hundred ( 100.00) dollars.
Section Eight
Pothing .n this Ordinance shall be construed in
any way authorizing the Commission herein to regulate the parr
Ing of cars, trucks, bicycles or the vehicle of locamotion upon
any of the streets or .elsewhere In the City of Caldwell*
d all Ordinances or parts of Ordinances in
conflict herewith are hereby repealed,
