PARTS OF ORDINANCES dFLICTING HEREWITH.
BE IT ORDAINED AND ESTABLISHED BY THE Y "AYOR AND
COUNCIL OF THE CITY OF " "CALEWELL, CANYON COUNTY, IDAHO;
Section to
Any person or persons who shall cut, break, damage
or In any way interfere,with any ditch, canal, headgate,
or lateral or water works or appurtenant thereto, the
property of the City of Caldwell or any irrigation distrieto
person, or association of persons, whereby water is con-
ducted to any place for beneficial use or purpose and
when said canal, headgAte, ditch, darn, or appurtenance
is 'being used or to be used for said distribution of water
and any person or persons who shall cut, 'break, injure,
destroy, enlarge, change or.alter any headgate, sluiceway,
weir, grater box, or any other measuring device to the
property of the City of Caldwell or any irrigation district,
corporation, or association of persons or in the possession
of or in the use of the said City of Caldwell irrigation,
district, corporation, or association, the property of
another or any person who shall change, .alter, destroy,
disturb, enlarge or in any matter interfering with any
headgate, dam, weir, water box, or other measuring device
made, placed, used or regulated by any duly appointed,
elected, or authorized water master, deputy water master,
ditch walker, ditch rider, engineer, or other authorized
agent of the said City of Caldwell, or of any irrigation
district, corporation or association otperson, when such
measuring device is used or is to be used for the measure-
ment of water, or any person who shall wilfully waste water
for irrigation, or who shall wilfully opens close, change
or disturb, or interfere with, any headgate or water box
or measuring device, without authority, or any person who
shall do or perform or shall violate any provision of this
act herein in this section mentioned or enumerating shall
be deemed to be guilty of a misdemeanor: and shall be
punished by a fine J. shall 'not exceed One Hundred
($100) Dollars,
Section 2e
All ordinances or parts of ordinances in conflict
herewith in so far as they are affected by this ordinance
but not the same are hereby repealed•
