declared to be necessary for, and to be taken for the pure
pose of said, street, rpad, highway, or avenue, under a by
virtue of the runt of Eminent Domain` granted to municipalitie
under and by virtue of the laws of the estate of Idaho.
See. 5. That each person an all persons whose property
shall be tapen or injured by the virtue of this ordinance,
and the creation, establishing, laying out, and extending
of each street, - road, highway, or avenue, under the poorer
of Eminent Domain, gran,teed to the City of Caldwell,, or
municipalities of the second class, under the laws of the
estate of Idaho, shall be radcqua.tely compensated therefor, to
be determined by the assessment of five disinterested hol-
ders, who shall be hou e holders and real 'estate holders in
the City of 04ldvell, „Idaho.

Sec. 4. That for the purpose of determining the amount
of ga4pensatioa to be paid by the City of Caldwell to per`-
sons whose property is taken or injured by the _creation,
establishing, laying but, and extending of said street, road,:
highway, or avenue provided for in Sec. l of this ordinance,
the Mayor and Council' of the City of Caldwell shall elect
five disinterested holders, rho 'pre residents and electors
