BE IT ORDAINED BY I MAYOR AND CI'[Y COUNCIL OF THE4 CITY OF CALM�IFML, IDAHO: Section 1. That there is hereby created within the City of 0aldv. Idaho, a Planning Commission to consist of twelve members to be appointed by the Mayor of the City of Caldwell, and confirmed by the Council* Section 2. That the me of the Planning Com- mission shall be composed of the following persons: Mayor of the City of Cald one member of the Coun- 611; the City Engineer; and the Cit7T Attorney, who shall be ex- officio members of the Planning Comm. ission. That the remaining members of the Planning Commission, who are appointed membe.^s, shall be residents and tax payers of the City, provided that one meTnber of the Commission to be appointed, may, if in the judgment of the Mayor it is re- quired, be a non-resident tax payer of the City* Section 3. The term of office of the ex-officio mem- bers of the Planning Commission shall be co-extensive with their tenure of office, as city officials of the City of Ca ldwe 11. Section 4. That the tanure of office of the other members of the Planning Commission shall be two, four and. six years; one-third of their number shall hold office for two years; one-third of their number shall hold office for four years; and one-third of their number shall hold office for six years. Immediately upon their appointment, or as soon thereafter as may conveniently be done, the Board shall -ieet and lots shall be cast to determine which of the members shall hold office for two years, and which of the members shall hold office for four years, and which of the members shall hold office for six years, and thereafter the term of office of those who are appointed, other than the ex- officio members of the Board shall hold office for a full term of six years, unless they should sooner remove from the City of Caldwell, die, or resign from the Boaxd, or be removed by a public hearing and by majority vote of the Council of the City of Caldwell. Section 5. Vacancies occuring in the Planning Com- mission, either by expiration of term of office of said commissioner or by resignation, death or removal from the City of Caldwell, or by removal after a publichear- ing by a majority vote of the Council, their successors shall be appointed and confirmed in the same manner as the original terms were made. Notice of public hearing to consider removal of a commissioner shall be published in a newspa par at least five (5) days prior to the hearing, and shall state, time place and purpose of the hearing. Section 6. The Commission shall elect its own Chair- man and create and fill such other offices as it may determine it requires. { Section 7. Regular meetings Of' he Planning Com- mission shall be held at the Council chambers of the City of Ca ld iell, on the I dk n W J . Monday of each Tonth; at such Meeting a majority of the appointive members of the Commission shall be necessary to consti- tute a quorum. All business of the meetings shall be public and wri'�ten rules not inconsistent with the laws of the State of Idaho shall be adopted by the Commission, describing their order of business. The Secretary of the Commission shall keep a written record of the minutes of all meetings, findings, resolutions and determinations, which record shall be a public record. Section S. Expenditures of the Manning Commis- sion shall be within the amounts, and not exceed the amounts appropriated and set aside by the City in arq one year for the purposes of the Commission and may in addition thereto expend such funds as may come to it by way of gifts, but in no event shall any of its expendi- tures be, or, exceed the amount that comes to it by ap- propriation by the City and gifts from other sources. Section 9. The members of the Commission shall receive no compensation for their services, but they may eiploy such employees and technical advisers as the Commission may deep necessary for ti :6e appropriate carrying out of its work; such employees and technical advisers shall be paid for their services by funds al- lowed to the Commission as gifts or appropriation by the City. Section 10. It shall be the duty of the Commis- sion to reccommend and make suggestions to the City Coun- oil for the adoption of co-ordinate plans for the physi- cal development of such city; for the formation of zoning districts; to make suggestions concerning the laying out, widening, extending and locating of streets, rods and high - ws for the relief of traffic; to make suggestions con- A &41 cerning density of population and devel,3pment of . AY; to make suggestions concerning the future growth, develop- ment and beautification of the city, in respect to its pub- lic buildings, streets, parks, grounds and lands consistent with the future growth and development of the city, in or- der to promote the public health, morals, safety and wel- fare of the inhabitants thereof; to give suggestions, and advice to individuals concerning landscaping or location of buildings, structures of works to be created, construc- ted or altered by or for such individual. I Section 12. The Planning Commission shall have au- thority to acquire by gift, demise or bequest lands or per- sonal property to carry out its purposes, and shall like- wise have the power to sell, convey and otherwise dispose of the same; all conveyances made by the Planning Commission shall be pursuant to a resolution of the Planning Board firs entered upon its minutes, and be executed by the Chair- man, duly attested by the Clerk and acknowledged before an office sat'I'lorized to take and certify to acknowledgments.
