IS SOLD TO THE CONSUMER, A14D PROVIDING A PENALTY FOR
i'HE VIOLATION OF THIS ORDINANCE, AND REPEALING ALL OR"
DINANCES IN CONFLICT WITH THIS ORDINANCE, PROVIDING A
SAVING CLAUSE, AND DECLARING AN EMERGENCY," DEFINING
THE WORD "BEER," AND PROVIDING THq AMOUNT OF THE AN-
NUAL LICENSE FOR THE SALE OF BEER q)-0 THE CITY OF CALD-
WELL, IDAHO.
BE IT ORDAINE BY THE MAYOR AND OOUNCIL OF THE CITY OF
CALDWELL, C COUNTY, ID AHO:
That Subdivision (a) of Section 1
and Section 3 of Ordinance No. 508, entitled "AN Ordin-
ance Licensing and Regulating Places of Business Where
Beer is Sold to the Consumer, and Providing a Penalty
for the Violation of this Ordinance, and Repealing all
Ordinances in Conflict with this Ordinance, Providing
a Saving Clause, and Declaring an Emergency," be and
the same are amended to read as follows:
Section 1. That Subdivision (a)
of Section 1 of said Ordinance No. 508 be, and the same
is hereby, amended to read as follows:
Section 1. DEFINITIONS.
(a) Beer. The word "beer" as used
in this ordinance means any beverage obtained by alcohol-
ic fermentation or of an infusion or decoction of bar ley,

malt and /or other ingredients in drinkable water, as is
defined, prescribed and limited by the statutes of the
State of Idaho.
Section a That Section 3 of said
Ordinance N 508 be, and Vie same is hereby, amended to
read as follows:
Section 3.
The license fee to be paid by per-
sons who are the proprietors of places of business where
the beer is sold to the consumer shall be Fifty and No/
100 Dollars ($50.00) per annum. Said license fee shall
be in addition to all other license fees required by
other ordinances of the City of Cald,vell, Idaho. For
the purpose of this ordinance the year shall commence
with the first day of JuV, and each license granted
shall be issued as to expire at midnight on the 30th day
of June, following its issuance. The license fee shall
be paid annually in advance before such license.is issued.
Section 3. That all ordinances and
parts of ordinances in conflict with this ordinance are
hereby declared to be, and the same are hereby, repealed.
