then the City under the ,supervision'of Street

to exterminate, eradicate, destroy, remove, or abate
such diseases, pests, worms -�. beetles, eggs amd /or"
larva of arty pests, worms beetles, or diseases. or
i the ;Mayor declares the condition to be an emexgenoy
rewiring immediate attentIon,he may,direct the'Street
Commissioner to proceed at once 'to pkterm pate eradicate,
destroy, remove, or abate'`the'same without further notice.
Se ction 3.
Whenever any such diseases,, pests, worms, beetles,
eggs and /or larva of any pests, worms, beetles, or
diaeas,es infesting any; trees, vines, shrubbery, or
plants upon the land o`r lots .owned by the owners of pro -°
pe`rty within the City of Caldwell,, or upon lande
lots adjacent to any of the public streets or alleys
in the 'City of Caldwell shall. have been eradicated,
destroyed, removed, or abated bg the Street Commissioner'
ss herein provided, the cost for labor and material
for the eradication, destruction, removal or abatement
of such diseases, or pests,; worms, beetles', eggs and /or
larva shall'`be levied and aese'ss'ed by the Council against
and upon such property whether the same is owned -by a
perEfen, firm; company, or' corporation, or abutting upon
any street or alley w"ith.in the City of Caldwell and
shall be levied and aasesaed in the same manner. as other
city taxes are levied or ass -essed and such assessments
shall b`e collected by. the Treasurer of the City of
Caldwell. who shall place the same upo the tax rolls
for collection as a special assessment in addition to
the taxes for general'revenue purposes and shall col
l:ect the same in the manner' and sub jeot to the same
penalties and interest provided by law for other city
special: assessments.
Section 4.
,Any tr es , shrubs, vines, or plants .fo=und ` infested
with any such diseases: or pests, worms, beetles, eggs
and /or larva; of any pests,, worme, beetles,`or ,diseases
are hereby declared to' be a. public nuisance.
Sectio 5 .
All ordinances, or parts of ordinances, in conflict
with this ordinance are hereby repealed.
