of the City of Caldwell, Idaho, as follows:
Section 1. The ter* "ai,rcraftT means any con-
trivance norfr known or hereafter invented, used or
designed for navigation or flight in the air, ex-
cept a parachute or other contrivance designed for
such navigation but used primarily as safety equi,p-
ment.
Section 2 The terx, airman means any iA'*
dividual (including the person in command and any
pilot, mechanic or member of the crew) who engages
in the navigation o aircraft while under gray, and
any individual who is in charge of the inspection,
overhauling, or repairing of aircraft.

using the airport as a permanent base, or shall have
first secured permission fron the Caldwell Airport Com-
mission and shall have paid the Pees and charges pres-
cribed.

combustible liquids, or within any hangar :or workshop

Section 17. No intoxicating liquor shall in any
way be brought upon the field. No passengers or airmen
are permitted to use or to ride in planes while drink
in or in an intoxicated condition. TTo :person will be
authorized or permitted to use this airport or flying
field for the violation of any lair of V e ?united States
or the State of Idaho, or ordinance of the City of
Caldwell, for any unlawful or i-M.Oral purpose whatever.
Section 18. 'Tnited States snail planes have right
of way over all other air traffic, and it must in no
way conflict with operations of the same
Section 19. Yo hangar or l.angars shall be cons-
tructed or erected upon this field except with the
written consent of the Airport Commission, at a loca-
tion or locations to be desiiIiated by said co Mission.
Such hangar or hangars to be onstructed only in ao-

or approved by the Caldviell Airport Commission. And
no lease, sublease, purchase, sale or transfer of
hangar or hangars shall be made or'becorne effective
without the approval of the airport commission.
Section 20 Aircraft being used for instructions
shall be given right of way wl,,.en near the ground. In-
structors are cautioned against flying over active por-
tions of the field except in taking off or lancing.
Student fliers are prohibited frog. flJing over the busi-
ness or thickly settled residence portions of the city.
Section 21. ,co aircraft shall 'be_ fueled in the

Section 45. The City of Caldwell assumes no res
ponsibility for the loss or damage of any property in

firm or corporation operating from the Caldwell. lluni-
cipal Airport.
Section 46. Any person or persons w "onsoever
using this airport for any aviation purpose will be
required at any and all ties, to strictly observe
and comply with the air traffic laws of the United
:Mates and of the State of Idaho and the ordinances
of ti -le City of Caldwell, and the violation of any such
laws or regulations will 'be deemed to be °sufficient
ground or reason for refusing further permission to
use this airport or flying field,_
Section 47. 1 in this ordinance the 'Germ
"airport commission ", "comra,ission" or "Caldwell Airport
CtxLaission" is used the same shall be construed: to mean
the Cal(Liell 74unicipal Airport Commission; and where-
ver the tarn "airport'' or "Caldwell Airport" is used,
the same shall be construed to mean the Caldwell
Municipal Airport

Section 48. Every person or persons, firm,
company or corporation who shall violate, disobey,
Nr or refuse to comply with any of the provisions of
this ordinance, shall be deemed guilty of a misde-
meanor and shall upon conviction. thereof be punished
by a fine not exceeding One hundred ($100.00) Dollars.
Section 49 All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
Section 40. This ordinance shall be in force and
shall take effect from and after its passage, approval
and publication.
