( ORDINANCE NO. *6 BY McCONNELL. -0-0-0- AN ORDINANCE PROVIDING FOR THE APPOINTMENT OF A CITY ENGINEER, FIXING HIS COMPENSATION, PRESCRIBING HIS DUTIES, AND REQUIRING THAT HE SUBSCRIBE TO AN OATH OF OFFICE AND EXECUTE A BOND TO BE FIXED AND APPROVED BY THE CITY COUNCIL; PROVIDING THAT THE CITY ENGINEER SHALL BE EX-OFFICIO OVERSEER OF STREETS, BUILDING INSPECTOR, SUPERINTENDE14T OF WATER TIORKS, AND SUPER- INTENDENT OF IRRIGATION; DEFINING HIS DUTIES AS SUCH EX-OFFICIO} PROVIDING FOR THE EMPLOYMENT OF ASSISTANTS FOR THE CITY ENGINEER AND HIS DEPARTMENTS, AND PRESCRIBING THE METHODS OF FIXING AND PAYING ZHE COMPENSATION OF SUCH ASSISTANTO-i PROVIDING FOR THE REIMBURSEMENT OF THE GENERAL FUND FOR SERVICES RENDERED BY THE CITY ENGINEER OR HIS ASSISTANTS TO IMPROVEMENT DISTRICTS, AND THE PRO-RATING OF THE SALARY OF THE CITY ENGINEER ,TO THE SEV- ERAL DEPARTMENTS UNDER HIS SUPERVISION; MAKING IT UNLAWFUL TO HINDER, MOLEST, INTERRUPT OR INJURE, THE CITY ENGINEER OR HIS ASSISTANTS WHILE ENGAGED IN OFFICIAL DUTIES; PRESCRIBING PE11- ALTIES FOR THE VIOLATION OF THIS ORDINANCE- AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; BE IT ORDAINED By the Mixyor and Council of the City of Caldwell, Idaho: Section 1. The Mayor shall have the power to and shall appoint, during the term for which he is elected, subject to confirmation by the City Council, a competent person to hold the position of City Engineer, who shall hold his office during the term for whihh he is appointed and until his successor is appointed and qualified. The City Engineer shall receive as full compensation for his aer- vices the sum of Two Thousand Seven Hundred Dollars per annum, pay- able monthly, as are the salaries of other city officers. 9 Sec. 4. For the compensation paid him b6a City Engineer, and 0 " no mores, the City Engineer shall perform all of the duties im, posed by law upon the Overseer of Streets, aA-by ordinance upon the Building Inspector, Superintendent of Waterworks, and Super- intendent of Irrigation, and as such shall be ex-officio Street Commissioner, or Overseer of Streets, Building Inspector, Super- intendant of Water Works, and Superintendent of Irrigation, and in such capacity shall exercise all the powers conferred by statute or ordinance upon the Overseer of Streets or Street Commisaioner, BuIlding Inspector, Superintendent of Water Works, and Superintendent of Irrigation. Sec. 3. Before entering upon his duties as such engineer, the City Engineer shall take and subscribe to the official oath required; and shall execute a good and sufficient bond in an amount to be fixed and approved by the City Council, conditioned for the faithful performance of his duties. The premium on such bond shall be paid by the city. Sec. 4. In addition to the duties imposed upon him by law it shall be the duty of the City Engineer to locate the lines and grades of all streets and sidewalks, alleys, avenues, or other public ways, and to determine the position, size and construc- tion of all sewers, water works, irrigation or drainage canals, reservoirs, culverts, aqueducts, bridges, viaducts, or other public works, or appurtenances, and to prepare plans, maps, or profiles, of the same; to make estimates; and furnish specifi- cations for any of such work, whenever required to do so by the 11ayor or City Council. He shall have general supervision of all co ntracts or other work and see that it is performed in a work- ont manlike manner, and in accordance with'the authorized plans and in accordance with the terms of the contract and specifications. Sea. 5. The mayor upon the request and recommendation of - the City Engineer may appoint, subject to confirmation by the Council, such assistants and employees as the necessities of the engineer's office and departments may demand. The compensa- tion of such employees shall be fixed by the City Engineer with the approval of the Council. Such alaries shall be paid monthly -a- I � Al 0 6 as are salaries of other city employees, and charged to the de- partments for which such services shall have been rendered. Sec. S. The City Engineer, as Ex-officio Overseer of Streets shall have, to the orders of the Mayor and Council, gen- eral charge,. direction and control of all work on the streets, sidewalks, culverts, cross-walks, and bridges of the city, and shall perform such other duties as may be prescribed by law, or the Council may require. Sec. 7. The City Engineer, as Ex-Officio Building Inspector shall examine and pass upon all building applications referred to him. Be shall require from the person applying for the permit such detailed plans and specifications as will enable him to pass upon said application and make recommendations to the City Council. Said building :Inspector shall work in conjunction with the Chief of the Fire Department and they shall make such recom- mendations to the City Council as they shall deem necessary. It shall be his further duty to ingpeot all buildings while in the process of construction; and if the construction of the same is not in accordance to the plans submitted, he may stop such work at any time and give notice thereof to the person in charge of the construction of suoh building that the construc- tion shall not proceed until the same is made to conform to the rules and regulations governing the construction of such build- ings. Be shall perform such other duties as may be prescribed for the Building Inspector by ordinance, or the Council may require. Sec. S. The City Engineer, as Ex-officio Superintendent of Water Works shall, under the direction of the Mayor and Council, have charge of the reservoirs, water tanks, water mains, water- motexe, fire hydrants, and all machinery, property and appurten- N 7 &noes appertaining to the waterworks. lie shall have the direc- tion of the laying of water mains, putting in of service pipes and the regulation of water supplies to the fire hydrants and to all iratertakers. He shall report • to the Mayor and Council annually, or as often as required, his doings as Superintendent of Waterworks, the condition of the waterworks, and make such suggestions as the nature of the service shall require. He shall perform such other duties as may be prescribed by law, or the Council may require. Sec. 9. The City Engineer, as Ex-officio Superintendent of Irrigation shall, under the direction of the Mayor and Council have charge of the irrigation system, ditches, drains, conduits, and all machinery, property and appurtenances appertaining the irrigation system. He shall have the direction of the laying out, enlargement, construction or alteration of ditches, canals, flumes, drainage ways, wasteways, and the regulation of the distribution of water for irrigation purposes within the city He shall report to the mayor and Council annually, or as often as required, his doings as Superintendent of Irrigation, the condition of the irrigation system, and make such suggestions as the nature of the service shall require. He shall perform such other duties as may be prescribed by law, or the Council may require. Sec. 10. Whenever the Ctty Engineer or any employee of his office shall supervise or superintend or have charge of any street improvement or improvements of any kind for the paytent of which a special assessment shall be levied on the abutting, fronting or contiguous property, there shall be paid from such special assessment fund a sum of money sufficient to yey for the services of the City Engineer or any employee of his office, I" to done in connection or in conjunction with said improvement work, und said sum of money 3o received shall be deposited 'by the City Engineer viith the City Treasurer and placed in the general fund.
