AN ORDINANCE SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF CALDWELL, IN THE COUNTY OF CANYON, STATE OF IDAHO, Who ARE TAX PAYERS THEREOF, FOR THEIR VOTE'AND DETERMINATION UPON THE FOLLOWING QUESTIONS: FIRST, THE QUESTION OF ISSUING MUNICIPAL COUPON BONDS OF SAID CITY, TO AN AMOUNT AGGREGATING THE PRINCIPAL SUM OF FIFTY-TWO THOUSAND DOLLARS ($52, 000.00) FOR THE PURPOSE OF IMPROVING THE STREETS AND ALLEYS AND PARTICULARLY THE STREET AND ALLEY INTERSECTIONS IN SAID CITY; SECOND, THE QUESTION OF ISSUING MUNICIPAL COUPON BONDS OF SAID CITY TO AN AMOUNT AGGREGATING THE PRINCIPAL SUM OF THIRTY THOUSAND DOLLARS( 30,900.00) TO PROVIDE FOR THE ENLARGEMENT, EXTENSION, REPAIR, ALTERATION AND IMPROVEMENT OF THE MUNICIPAL WATERWORKS PLANT OF SAID CITY; AND THE LEVY AND ASSESSMENT OF DIRECT ANNUAL AD VALOREM TAXES UPON ALL THE TAXABLE :PROPERTY IN THE SAID CITY SUFFICIENT TO PAY THE INTEREST ACCRUING UPON EACH OF SAID ISSUES OP' BONDS PROMPTLY WHEN AND AS THE SAME BECOMES DUE, AND ALSO, AT THE LAWFUL TIME, FURTHER ANNUAL AD VALOREM 0 TAXES ON SAID TAXABLE PROPERTY SUFFICIENT TO CONSTITUTE AND MAIN- TAIN SINKING FUNDS FOR THE PAYMENT OF THE PRINCIPAL OF EACH OF SAID ISSUES OF BONDS WITHIN TWENTY YEARS FROM THE TIME OF THE ISSUE OF TIRE SAME; AND PROVIDING FOR AN ELECTION TO BE FIELD IN AND FOR SAID CITY FOR SAID PURPOSES ON 8 SCZCl �� , THE ZO DAY OF A. D 1919, PRESCRIBING THE FORA OF NOTICE TO BE GIVEN TO THE ELECTORS OF SAID CITY FOR THE HOLDING OF SAID ELECTION; AND ALSO PRESCRIBING THE FORM OF BALLOT TO BE 1',IWIED IN VOTING AT SAID ELECTION, AND NAMING THE PLACE OF BOLDING SUCH ELECTION, AND NAMING THE ELECTION OFFICERS TO SERVE THEREAT; DECLAR- ING AN EMERGENCY WHEREBY THIS ORDINANCE SMALL TAKE EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND DUE PUBLICATION; AND REPEARING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT HEREWITH. IffhEREAS, it appears to the Mayor and Council of the City of Caldwell, in the County of Canyon, in the State of Idaho, that it would be, and it is here W deemed advisable to issue the following municipal coupon bonds of said City; First - municipal coupon bonds of said City to an amount aggregating the principal sum of Fifty -two Thousand ($52,000.00) Dollars, for the purpose of improve streets and alleys and particularly street and alley intersections in said City; Second - Municipal coupon bonds of said City to an amount aggregating the principal sum of Thirty Thousand ($30,000,00) Dollars for the purpose of enlarging, extending, repairing, alter- ing and improving the municipal waterworks plant of said City. Now, Therefore, In Consideration of the Premises BE IT ORDAINED, BY THE MAYOR AND COUNCIL OF THE CITY OF CLADWELL, IN THE COUNTY OF CANYON, IN THE STATE OF IDAHO: SECTION I. That a special election be, and the same is hereby called and ordered to be held in and for said City of Caldwell, in the County of Canyon, in the State of Idaho, on Tuesday towit: The 20th day of May, A.D. 1919, beginning at the hour of Nine o'clock in the morning, and closing at the hour of seven o'clock Xx P,A+I., for the purpose of taking the vote of the qualified electors who are tad payers of said City, upon the following questions, for their vote and determination thereat, towit: FIRST QUESTION: ":Shall the Mayor and City Council of the City. of Caldwell, in the County of Canyon, in the State of Idaho, issue and sell the municipal coupon bonds of said City to an amount aggregating the principal sum of Fifty -two Thousand Dollars ($52,000.00) for the t Purpose of improving streets and alleys, and particularly street and alley intersections in said City; and levy and assess a direct annual ad valorem tax on all the taxable property in said City sufficient to pay the interest accruing on said bonds promptly when and as the same becomes due, and also at the lawful time, a further annual ad valorem tax upon said taxable property sufficient to constitute and maintain a sinking fund for the payment of the principal of said bonds within twenty years from the time of issuing the same?" SECTION 2. That all p34sons who, at the time of said election, are qualified electors and tax payers of said City, and no others, shall be qualified to vote at said election upon the q�estione submitted as aforesaid. SECTION 3. SECTioN 4. That the Clerm of said City shall give thirty (30) days notice of such election by publication in "The Caldwell Tribune" a weekly newspaper printed and published in Caldwell, Idaho, hereby declared, determined and adjudged by said City of Caldwell tote the official newspaper thereof, and by posting at each of the three polling places where the election Is authorized to be held, as hereinafter provided, a notice in substantially the following form, to wit: PUBLIC NOTICE OF SPECIAL MUNICIPAL COUPON BOND ELECTION TO BE HELD IN THE CITY OF CALDWELL, IN THE COUNTY OF CANYON, IN THE STATE OF IDAHO, ON TUf-S47AY , MAY 20 A. D. 1919. STATE OF IDAHO, COUNTY OF CANYON, SS. CITY OF CALDWELL, Pursuant to the laws of the State of Idaho, and Ordinance Yo. of the City of Caldwell, in the County of Canyon, in said State, passed and approved on the 7th day of April A.D. 1919. PUBLIC NOTICE IS HEREBY GIVEN That a special election will b e held in and for said City on 'TUESIJ/\Y , to wit: The 2 ® day of May, A.D. 1919, beginning at the hour of o A. M., and closilff at the hour of 7_ o +clock P. M. of said day, for the purpose of taking the vote of the qualified eleotore who are taxpayers of said City upon the following questiohs, to wit: FIRST QUESTION: "Shall the Mayor and City Council of the City of Caldwell, in the'County of Canyon, in the State of Idaho, issue and sell the municipal coupon bonds of said City to an amount aggregating the prin- cipal sum of Fifty -two Thousand Dollars 352,000.00) for the purpose of improving streets and alloys, and particularly street and alley inter- sections in said City; and levy and assess a direct annual ad valorem tax on all the taxable property in said City sufficient to pay the interest accruing on said bonds promptly when and as the same becomes due, end also at the lawful time, a further annum ad valorem tax upon said taxable property sufficient to constitute and maintain a sinking fund for the payment of the principal of said bonds within twenty years from the time of issuing the same?" SECOND QUESTION: "Shall the mayor and pity council of the City of Caldwell, in the County of Canyon, in the State of Idaho, issue and sebl the muni- cipal coupon bonds of said City to an amount aggregating the principal sum of Thirty Thousand (03 0,000.00) Dollars to provide for the enlarge- ment, extension, repair, alteration and improvement of the munioip al waterworks plant of said City; and levy and assess a direct annual ad valorem tax on all of the taxable property in said City suffioient to pay the interest accruing upon said bonds promptly when and as the same bsoomse due, and also, at the lawful time, a further annual ad valorem tax on said taxable property sufficient to constitute and maintain a sinking fund for the payment of the principal of said bonds within twenty years from the time of issuing the same ?' The polling places for said election shall be as follows: First Ward: County Court House, in the hall, Second ?lard: Methodist Church, in the basement, Third Ward: Caldwell City V in the Council Room. All persons whe, at the time of said election are qualified electors and taxpayers of said City, and no others, shall be qualified to vote at said election on said question. At any time during office hours preceding the said election, the undersigned city clerk, or his duly appointed deputy, will register all electors who are qualified to vote at the said election. The voting at said election shall be by ballot,and the ballots shall be supplied to the voters for their use at said eleotion,and shall be in the form set forth in said Ordinance No. - " q. - u Dated at Caldwell, Idaho, this 8 day of April A. That in case the issuance of said bonds to provide for the improvement of ®treats and alleys shall be approved by said electors', then by virtue of, and in pursuance of Chapter 12 Of title 13, Political Code of the Revised Codes of Idaho, and the amendments thereto, and Chapter 159 in title 30 of Compiled Laws of Idaho of 1919, there shall be and there are hereby ordered, author- ized and directed to be issued, negotiated and sold in the manner provided by law, the municipal coupon bonds of said City to the amoun of Fifty -two Thousand Dollars; that said bonds shall be known as and r designated "Municipal Street Improvement Coupon Bonds;" shall be P fifty -two in number; numbered consecutively from one to fifty -two, both numbers inclusive, of the denomination of One Thousand Dollars (,$1000.) each; that in case the issuance of said bonds to provide for the enlargement, extension, repair, alteration and improvement of said municipal waterworks plant, shall be approved by said electors there shall be and there are.hereby ordered, authorized and directed to be issued, negotiated and sold in the manner hereinafter provided, municipal coupon bonds of said City to an amount aggregating the principal sum of Thirty thousand Dollars; that said bonds shall be known as and designated "Municipal Waterworks Coupon Bonds;" shall be thirty (30) in number; numbered from one to thirty, both numbers inclusive, of the denomination of One Thousand Dollars each. SECTION 7. That`in case of the issuance of said bonds or any of the same, said bonds shall be dated on or about the lot day of June A.D. 1919, but the exact date said bonds shall tear, their form, terms and maturity dates shall be fixed by ordinance hereafter to be adopted after the Mayor and Council have determined the best terms upon and the lowest rate of interest at which such bonds oan be negotiated. SECTION g. T hat in case of the issuance of said bonds, or any of the same, there shall be levied upon all of the taxable Property of said City a direct annual ad valorem tax sufficient for the payment of the Merest on said bonds promptly when and as the same accrues; and after said bonds hate been issued for a period of ten years in addition totthe tax for interest, there shall be levied upon all the taxable property in said City, a direct annual ad valorem tax sufficient to produce a sham which will dis- charge in each year one -tenth of theprincipal amount of said bonds. SECTION 9. That, Whereas, it is necessary for the public peace, health and safety to immediately enlarge, extend, repair, alter and improve the municipal waterworks plant, and supply the same with water for the purpose of supplying water to said city and the in- habitants thereof, for all purposes, and improve streets and alleys, an emergency is hereby and herewith declared to exist, and this ord1nance shall therefore take effect and be in force from and after its passage, approval and due publication, and shall be irrepealable until the indebtddness hereby created, both as to prim ipal and interest, shall have been fully paid and satisfied. SECTION 10. That any and all ordinances, or parts thereof, in conflict herewith, be and the Same are hereby repealed. PASSED: This Z day of April, A.D. 1919.
