State of Idaho,, a Local Improvement District, which shall be and is an Extension of Vocal Sewerage Improvement District No. 1., and shall be known as °'Local Lateral Sewerage Improvement District No. 5", and - ,which is bnunded and described as fo lloras, to -wits Beginning at the Flushtank of Local Sewerage Improvement District No..l, at the intersection of the.alley and 11th Avenue between Blocks 79 and 80 of the Original Town of Oaldigell, Canyon County, State of Idaho, as shown on the official plats thereof, on file and of record in the office of the County Recorder of said Canyon County, and from thence extending in a South -easterly direction in said alley between Blocks 80, 81, and 82 of the Original Town of. Caldwell and Blocks l and 2 of Dorman''s Addition to Caldwell,_and the Oregon Short Line thence South- westerly a distance Railroad, a distance of 1230 feet,, of 148 feet to the oenter.line of Main Street, thence Uorth- westerly on Im�Street a distance of 1230 feet to .11th Avenue, thence 'north- easterly on 11th Avenue a distance of 148 feet to the point of beginning, and including within said Improvement District Blocks 80, 81, aud.82 of the 'Original Town of Caldwell, and Block 1 and Lots 1 and 2 of Block 2 of Dorman's Addition to said 'Torn of Caldwell. 1. 1 Section 2. The Mayor; of the City of G a I dwe 11 I's hereby', uthorizecl and directed -to appoint a. sewer committee cQFposed of three members,: .who are bona fide residents and substantial.'taxpayers . of the City of Caldwell,,..one of vrhom shall serve for; a period of one year.,, one for two years and one for three years,.:or until.their successors are appointed and qualified. Said Committee shall organize and elect a President a presi6ing officer of their number, who shall be styled "Chairman of the Committee'', appoint a Clerk and Treasurer, who shall bea.respectively the Clerk and Treasurer:of the City of Caldwell, Section 3. The Treasurer of said Committee shall give a good and sufficient bond$in addition to her official bond as treasurer of the r - City of Caldwell, in.the sum of Dollars conditioned for the faithful performance of her duties as such Treasurer of said Committee according to law. Section 4. The said Committee shall be and they are hereby authorized and directed to cause to be prepared plans, specifications and estimates of cost of the construction of Seaver System and Seyrerage - - - - - - - -- - -- _ _ _ ... ----- -- . Disposal 'Works . as herein provided, and 'to do all things necessary and proper to be done in the construction and completion of.such works, and for such.purposes said Committee shall have all powers provided for in Chapter 14, of Title 13,, of the political Code, of the Idaho Revised Codes, and all amendments thereof, Section 5i There shall be constructed in the City of Caldwell., by and through said Committee, a sewer system and disposal works so planned and constructed as to be directly beneficial to the property situated within said local Lateral Sewerage Improvement District 140.5, and in such manner as to b the said District with proper and necessary drainage and. sewerage pipes, lines and outlets, and to render- j to each parcel of land within said.Distriet benefits as nearly equal as may be. Section n. Upon the adoption of the plans and specifications as herein provided, the said Committee shall determine as nearly as may. be done the amount of money necessary to be raised for the construction 2 . and completion of said works. And thereupon the said Committee -, together with the standing committee on streets and alleys of the City Council, shall proceed to make an ro11 of the real property contained within the boundaries -of said Local,Zateral 2 Sewerage Improvement District Teo. 5; provided, however.,. that property occupied.by streets, cross streets and alleys within said District. shall not be included in said assessment roll. The said assessment roll shall contain the names of the owners of all of the within said Distriot and . a description of the same in separate parcels or tracts, the frontage in feet fronting upon all highways,, streets or alleys, and the amount; of special benefit accruing to each ..separate parcel or tract, and shall have said separate amounts.so apportioned as to equal in the aggregate the amount of money determined upon as necessary to be raised for the construction and completion of said works, as herein provided. Section 7. the said assessment roll shall be certified to the City Council by the said Committees making the same;, and the Clerk shall thereupon give notice,,as required by law,of the filing of said x assessment roll, and of the-time at which the City Council will hear and consider obj- ections to said assessment roll by any parties aggrieved as provided by law. Section 6. The said sewer system and w o.rks, when completed, shall be by said Committee turned over'to the,3jayor and City Council to be, maintained and operated by the City of Caldwell. Section 9.
