HomeMy WebLinkAboutORD 2834• 0 • 0 BILL NO. 19 ORDINANCE NO. 2834 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 8, ARTICLE 3, SECTION 08 -03 -07 OF THE CALDWELL CITY CODE; AMENDING CHAPTER 8, ARTICLE 3, SECTION 08 -03 -09 OF THE CALDWELL CITY CODE; AMENDING CHAPTER 8, ARTICLE 3, SECTION 08 -03 -25 OF THE CALDWELL CITY CODE; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1: That Chapter 8, Article 3, Section 06 -03 -07 of the Caldwell City Code is amended as follows: 08- 03 -07: ENFORCEMENT BY ANIMAL CONTROL OFFICER: (1) Responsibility Of Enforcement: The enforcement of this Article shall be the responsibility of the animal control officer within the incorporated areas of the City. The Sher-iff shall bestew the authority of a deputy sheriff upen the animal eentrel effieen Fees will be collected by the animal control officers, if applicable, to remove deceased small animals from public roads and rights of way. (2) Interfering With Animal Control Officer: It is unlawful for any person to hinder, molest or in any way interfere with any animal control officer while the officer is lawfully engaged in the performance of his /her duties. Section 2: That Chapter 8, Article 3, Section 06 -03 -09 of the Caldwell City Code is amended as follows: 08- 03 -09: LICENSING (1) Canine License Required; Application: A. Licenses: PAGE -1 • 0 • 1. License Required: It shall be unlawful of any person to own, harbor, keep or possess a canine more than three (3) months of age within the City without first procuring a license therefor. 2. Exception: The provisions of this Section shall not apply to any person visiting in the er ed °r°°°f City for a period not exceeding thirty (30) days, and owning or possessing a canine, if such canine is currently licensed or bearing the license issued by another municipality or other licensing authority, or if such person is a permanent resident where no such license is required. Section 3: That Chapter 8, Article 3, Section 08 -03 -25 of the Caldwell City Code is amended as follows: 08- 03 -25: PROHIBITED ACTS: (1) Nuisance Animals: A. Canines; Unlicensed Or At Large: Any canine found in the City either without a license or running at large in violation of the provisions of this Article is declared to be a nuisance and shall be impounded as herein provided. B. Canines In Public Buildings: 1. Prohibited: It is unlawful for any person to permit, allow, keep or carry any animal in, upon or within a public transportation facility. 2. Canine Fights Or Cockfights Prohibited: It shall be unlawful for any person to participate in any canine fight or cockfight within the Section 4: This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 5: This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue PAGE-2 0 0 0 0 in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 6: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled.
