ORDINANCE NO. 2832
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD
BE REZONED TO THE C-4 (FREEWAY COMMERCIAL) AND R -2 (MEDIUM DENSITY RESIDENTIAL)
ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY
OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING
AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF
CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission and following the public notice and hearing procedures as required in Section 10- 03 -03,
Caldwell Municipal Code, approved Case No. ZON -69 -10 (Centennial Blvd. Rezone) at a public hearing
held July 6, 2010.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be rezoned to C-4 (Freeway Commercial) and R -2 (Medium
Density Residential) zones:
Existing M1 Zone To C4 Zone:
This parcel is a portion of the NE % NE % of Section 21, T4N, R3W, BM, Canyon County, Idaho and is
more particularly described as follows:
COMMENCING at the NE corner of said NE % NE %; thence N 89 °42'41" W, 928.20 feet along the North
boundary of said NE % NE %; thence S 00 °17'17" W, 271.39 feet to a point on the southwesterly right -of-
way boundary for Frontage Road No. 3 as shown on the plans for I.D.O.T. Project No. 1 -80N- 1(67)27,
said Frontage Road No. 3 also known as Chicago Street, said point being the POINT OF BEGINNING;
thence southeasterly following said right -of -way 16.15 feet along the arc of a curve to the left having a
central angle of 0 0 46'25 ", a radius of 1195.92 feet, and a long chord which bears S 57 0 28'06 "E, 16.15
feet; thence S 57 E, 152.76 feet continuing along said right -of -way to an existing highway right -of-
way monument marking the northwesterly right -of -way boundary for Access Road No. 1 for said Project,
said Access Road No. 1 also known as Centennial Way; thence southwesterly following said right -of -way
for Access Road No. 166.16 feet along the arc of a curve to the left having a central angle of 18 0 57'18 ", a
radius of 200.00 feet, and a long chord which bears S 19 0 23'40" W, 65.86 feet; thence S 09 0 54'20" W,
120.35 feet along said right -of -way; thence S 81 0 22'03" W, 102.99 feet; thence N 00 0 17'17" E, 286.11
feet to the POINT OF BEGINNING. The above described parcel contains 0.66 acres, more or less.

This parcel is a portion of the SE % of Section 16 and a portion of the NE % NE % of Section 21, T4N, R3W,
BM, Canyon County, Idaho and is more particularly described as follows:
COMMENCING at the SE corner of said SE % of Section 16; thence N 89 0 42'41" W, 867.47 feet along
the south boundary of said SE % to the POINT OF BEGINNING; thence N 46 0 27'42" W, 813.69 feet to a
point on the northeasterly right -of -way boundary for Frontage Road No. 3 as shown on the plans for
I.D.O.T. Project No. I -80N- 1(67)27, said Frontage Road No. 3 also known as Chicago Street; thence S
55 °15'05" W, 136.58 feet to a point on the southwesterly right -of -way boundary for said Frontage Road
No. 3; thence along said southwesterly right -of -way boundary as follows: southeasterly 28.97 feet along
the arc of a curve to the left having a central angle of 9 0 30'29 ", a radius of 174.59 feet, and a long chord

point of intersection of the southeasterly right -of -way boundary for said Access Road No. 1 and the
southwesterly right -of -way boundary of Chicago Street; thence S 71 E, 148.27 feet along said
southwesterly right -of -way boundary of Chicago Street; thence N 43 0 58'55" E, 81.02 feet; thence N

Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell, Idaho as C4 (Freeway Commercial) and R -2 (Medium Density
Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
