ORDINANCE NO. 2822
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD
BE REZONED TO THE C -3 (SERVICE COMMERCIAL) ZONE; DETERMINING THAT SAID CHANGE
IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID
PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission and following the public notice and hearing procedures as required in Section 10- 03 -03,
Caldwell Municipal Code, approved Case No. ZON -68 -10 (Chaffin Rezone) at a public hearing held, May
3, 2010.
Section 2. The parcel is located at 2920 E. Linden Street in the City of Caldwell, Idaho and the applicant
has requested that said following described property should be rezoned to C -3 (Service Commercial)
zone:
The East % of the West'/ of the NW % of the NW % of the NE % of Section 35 in Township 4 North,
Range 3 West, Boise Meridian, Canyon County, Idaho.
EXCEPTING THEREFROM:
A part of the East '/z of the West '/2 of the NW % of the NW % of the NE % of Section 35, Township 4
North, Range 3 West, Boise Meridian, Canyon County, Idaho, more particularly described as follows:
BEGINNING at the SE corner of said East '/z of the West % of the NW % of the NW % of the NE %,
according to the plat of the Industrial Site Addition No. 3, on file in Book 8 of Plats at Page 16, in the
Office of the Recorder of Canyon County, Idaho; thence North 0 0 12'00" West, 409.50 feet along the west
boundary of said Industrial Site Addition No. 3; thence South 89 0 29'45" West, 165.89 feet parallel with the
boundary of said Industrial Site addition No. 3; thence South 0 0 12'30" East, 409.50 feet along the west
boundary of said East % West % NW % NW % NE %; thence North 89 0 29'45" East, 165.83 feet along the
boundary of said Industrial Site Addition No. 3 to the POINT OF BEGINNING.
ALSO EXCEPTING THEREFROM: The North 30 feet.
This parcel contains 0.82 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell, Idaho as C -3 (Service Commercial).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section S. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 17 day of May, 2010.
