ORDINANCE NO. 2812
AN ORDINANCE RECITING PETITION FOR VACATION OF PUBLIC RIGHT -OF -WAY
AND RECITING APPROPRIATE NOTICE WAS GIVEN; DETERMINING THAT
VACATION OF SAID PUBLIC RIGHT -OF -WAY IN THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO, DESCRIBED BELOW, SHALL BE MADE; AND DETERMINING THAT
VACATION OF SAID FOLLOWING RIGHT -OF -WAY IS IN THE BEST PUBLIC INTEREST
FOR THE CITY OF CALDWELL, CANYON COUNTY, IDAHO.
This request is for vacation of public right -of -way at 604 Arthur fronting Indian Creek. The
t is made to facilitate construction of a new Treasure Valley Community College.
-Said property being more particularly described as follows:
A parcel of land being a portion of the Right -Of -Way of Arthur Street being adjacent to a portion
of the Northeasterly line of Block 12 according to the plat filed December 10, 1883 in Book 1 of
Plats, Page 1, record of Canyon County, Idaho, and as appears by Revised Map of Caldwell,
Idaho filed in Book 1 of Plats, Page 20, records of said county, said parcel being situated in a
portion of the Southwest Quarter of Section 22, Township 4 North, Range 3W, Boise Meridian,
City of Caldwell, Canyon County, Idaho is more particularly described as follows:
Commencing at the centerline intersection of Arthur Street and 6 Avenue; thence along the
centerline of 6 Avenue South 43 °44'39" West 40.00 feet, thence leaving said center line South
46° 15'16" East 40.00 feet to the most Northerly corner of Block 12, said point being the POINT
OF BEGINNING; thence
\orth 43° 44' 38" East 20.00 feet, thence
South 46° 15' 16" East 100.08 feet along a line parallel with and 20 feet Northeasterly of said Northeastely line of
Block 12, thence leaving said parallel line
South 01° 15'05" East 28.29 feet to the Southwesterly Right -Of -Way line of said Arthur Street, thence along said
Southwesterly Right -Of -Way line
North 46° 15' 16" West 120.08 feet to the POINT OF BEGINNING;
Said parcel contains 2,202 square feet or 0.051 acres more or less.
Section 1. That by a motion passed by the Council and approved by the Mayor of the City of
-"Caldwell, Idaho, and statutory notice having been given to all property owners within three hundred
( 100) feet and published in the official newspaper of the City, in accordance with Section 50- 1306A,
Idaho Code, that an application has been presented to the Mayor and Council of the City of Caldwell,
Idaho, requesting passage and approval of an ordinance vacating the above described right -of -way
_�: cd in Caldwell, Canyon County, Idaho.

Section 2. That said right -of -way does not contain public or private utility lines.
Section 3. That it is hereby determined it is in the best interest of the public that the above -
described right -of -way in the City of Caldwell, Canyon County, Idaho be vacated.
Section 4. This resolution shall be in full force and effect from and after its passage and
publication according to law.
Section 5. This vacation is subject to the following precedent condition:
a. PETITIONER shall incur all costs related to this vacation.
Section 6. Be it ordained and established that the above - described right -of -way in the City of
Caldwell, Canyon County, Idaho, upon completion of all precedent conditions and vacation shall pass
and revert to the adjacent private property owner located at said 604 Arthur Street, City of Caldwell,
Canyon County, Idaho, in accordance with Section 50 -311, Idaho State Code.
PASSED BY THE COUNCIL of the City of Caldwell, Idaho, this _19th_ day of
