HomeMy WebLinkAboutORD 2782i BILL NO. 62 ORDINANCE NO. 2782 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL REPEALING CHAPTER 2, ARTICLE 11 (ENTITLED, "COMMUNITY SERVICES ADVISORY BOARD ") IN ITS ENTIRETY, SECTIONS 02 -11 -01 THROUGH 02 -11 -13 INCLUSIVE; ENACTING A NEW CHAPTER 2, ARTICLE 11 TO BE ENTITLED "MAYOR'S YOUTH ADVISORY COUNCIL," SECTIONS 02 -11 -01 THROUGH 02 -11 -03 INCLUSIVE; ENACTING A NEW CHAPTER 2, ARTICLE 31, TO BE ENTITLED "FRIENDS OF THE CALDWELL DEPOT," SECTIONS 02 -31 -01 THROUGH 02 -31 -05 INCLUSIVE; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1: That Chapter 2, Article 11 of the Caldwell City Code, Sections 02 -11 -01 through 02 -11 -13 inclusive, entitled "Community Services Advisory Board," is hereby repealed in its entirety. Section 2: That a new Chapter 2, Article 11 of the Caldwell City Code, to be entitled "Mayor's Youth Advisory Council" is hereby enacted, passed and adopted, composed of Sections 02 -11 -01 through 02 -11 -03 inclusive, as follows: 02- 11 -01: PURPOSE: The Mayor's Youth Advisory Council exists as the result of the recognition by the City of Caldwell that the youth of the city constitute an underutilized source of ideas, knowledge and experience with respect to the City and its affairs. The Mayor's Youth Advisory Council has been created in an effort to facilitate the input of ideas, knowledge and experience from the youth of the City, for the improvement of the City as a whole. 02- 11 -03: BY -LAWS: Written By -laws, consistent with this Article and other laws of the State of Idaho for the transaction of the business of the Mayor's Youth Advisory Council, shall be adopted. r � Section 3: That a new Chapter 2, Article 31 of the Caldwell City Code, to be entitled "Friends of the Caldwell Depot" is hereby enacted, passed and adopted, composed of Sections 02 -31 -01 through 02 -31 -05 inclusive, as follows: 02- 31 -01: PURPOSE: The Friends of the Caldwell Depot Association exists to renovate, restore and preserve the Caldwell Train Depot located in downtown Caldwell, Idaho; to preserve, promote and educate the membership and the general public concerning the history of the City of Caldwell through scale modeling, lectures, tours, events and publications; to preserve the history, memory and heritage of railroad facilities, equipment, and the railroad companies that operated in Caldwell, the Treasure Valley and the State of Idaho; to transact all lawful activities or promotions to raise funds which carry out the Association's purposes; to assist the City of Caldwell, Idaho, and any other individual or entity that has been or might be awarded grant funds, to facilitate the purposes of the Association; and, to exercise all powers necessary and proper to carry out the above stated purposes. 02- 31 -03: AUTHORITY: The City Council shall retain final authority regarding decisions concerning the Caldwell Train Depot, its use, hours of operation, and the nature of activities that occur at the Depot. However, the Friends of the Depot Association shall be charged with staffing, coordinating volunteer efforts, and engaging in promotional activities concerning the Depot, and shall have reasonable access to the Depot, even when otherwise closed to the public, in order to fulfill the purposes of the creation of the Association. 02- 31 -05: BY -LAWS: Written By -laws, consistent with this Article and other laws of the State of Idaho for the transaction of the business of the Friends of the Caldwell Depot Association, shall be adopted. Section 4: This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 5: This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 6: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled.
