ORDINANCE NO. 2780
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING
VARIOUS PORTIONS OF CHAPTER 6, ARTICLES 3, 5, 7 AND 21 OF THE
CALDWELL CITY CODE, SO AS TO ALLOW ALL FEES MENTIONED THEREIN
TO BE SET BY RESOLUTION OF THE CITY COUNCIL OR, WHERE APPLICABLE,
TIED TO THE MAXIMUM FEE ALLOWED BY THE STATE OF IDAHO; CLARIFIES
THAT AN APPLICATION FEE IS TO BE PAID TO THE POLICE DEPARTMENT AT
THE TIME OF APPLICATION FOR A PRIVATE PATROL SERVICE OR PRIVATE
PATROLMAN LICENSE, SEPARATE FROM THE LICENSE FEE TO BE PAID TO
THE CITY CLERK BEFORE ISSUANCE OF THE LICENSE; PROVIDING FOR AN
EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT
HEREWITH.
BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, County of
Canyon, State of Idaho:
Section 1: That Chapter 6, Article 3, Section 06 -03 -07 of the Caldwell City Code is amended
as follows:
06- 03 -07: LICENSED REQUIRED; FEE:
B. License Fee; License Tax: The annual license processing fee for each
pawnbroker shall be f dollars ($50 ) established by resolution of the City
Council This fee is necessary to defray the costs from the investigation of the
applicant and the processing of the application. This annual license processing fee
for a pawnbroker's license is in addition to the license tax imposed on
pawnbrokers by Idaho Code, section 63 -2303 as amended.
Section 2: That Chapter 6, Article 5, Section 06 -05 -11 of the Caldwell City Code is amended
as follows:
06- 05 -11: LICENSE FEE:

A per person license fee shall be paid in an amount established by resolution of
the City Council, valid for three (3) monthsof fi %. dollars (00 pe per—son fie..- three
(3) months. The license shall be exhibited in a conspicuous place if the licensee is using a
vehicle or a building in his business and otherwise must be kept by the person and
exhibited at any time upon request.
Section 3: That Chapter 6, Article 7, Section 06 -07 -23 of the Caldwell City Code is amended
as follows:
06- 07 -23: LICENSE FEES:
An applicant shall be charged by the city clerk the following application and
license fees to be payable at the time the license is issued. All license fees shall be paid to
the general fund of the city.
(1) Liquor By The Drink At Retail License: The maximum fee allowed by
the State of Idahosum of five - hun- dFed -sixty two dollars fifty eents- ($562.50) per
annum for the license year; provided, however, that if the license be issued for
less than a full calendar year, the license fee shall be prorated as of the actual
months of issuance but in no event for less than six (6) months
(2) Liquor Catering Permit: The maximum fee allowed by the State of
Idaho for each day the permit is to be effectivestim of twenty dollars ($20.00) per-
peffflit.
(3) Beer Retailer, On Premises Consumption License: The maximum fee
allowed by the State of Idaho per annum
for the license year provided, however, that if the license be issued for less than a
full calendar year, the license fee shall be prorated as of the actual months of
issuance, but in no event for less than six (6) months
(4) Beer Retailer, Packaged Beer License _ Not To Be Consumed On The

($200.0 maximum fee allowed by the State of Idaho per annum for the license
year; provided, however, should the license be issued for less than a full calendar
year, the license fee shall be prorated in accordance with the actual months of
issuance but in no event for less than six (6) months
(6) Wine Retailer License: The Hof two —hundred —dollars
($200.0% fee allowed by the State of Idaho per annum for the license
year; provided, however, should the license be issued for less than a full calendar
year, the license fee shall be prorated in accordance with the actual months of
issuance, but in no event for less than six (6) months.
(7) Transfer Fee: An amount established by resolution of the City

(8) Refund: In the event the city clerk should reject any application for
license renewal or transfer and there is no appeal of the decision of the clerk, the
city clerk, following the time for the period for which an appeal may be filed,
shall refund the amount of the license fee to the applicant which was submitted
with the application.
Section 4: That Chapter 6, Article 7, Section 06 -07 -35 of the Caldwell City Code is amended
as follows:
06- 07 -35: ALCOHOL BEVERAGE CATERING PERMIT:
(2) The application shall be verified by the applicant and filed with the
city clerk. A filing fee in the maximum amount allowed by the State of
Idahoamou t of *weRly dolla ($20 for each day the permit is to be effective
shall be paid to the city treasurer and finance director, which shall not be refunded
in any event.
Section 5: That Chapter 6, Article 21, Sections 06 -21 -07 and 06 -21 -17 of the Caldwell City
Code are amended as follows:
06- 21 -07: APPLICATION FOR LICENSE:
An application for a license, whether for private patrol service or private
patrolman, shall be made to the Police Department. At the time of filing an application,
the annlicant shall pav to the Police Department an application f in an amount to be set
by resolution of the city council. If the application is approved by the Police Department
pursuant to the provisions of this article, it shall be forwarded to the City Clerk.
06- 21 -17: LICENSE FEES:
The applicant shall pay a license fee, as set forth below, to the City Clerk prior to Pelise

Section 6: This ordinance shall be in full force and in effect from and after its passage,
approval and publication, according to law.
Section 7: This ordinance is hereby declared to be severable. If any portion of this ordinance
is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue
in full force and effect and shall be read to carry out the purposes of the ordinance before the
declaration of partial invalidity.
Section 8: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby
repealed, rescinded and annulled.
