ORDINANCE NO. 2758
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD
BE REZONED TO THE R -3 (HIGH DENSITY RESIDENTIAL) ZONE; DETERMINING THAT SAID
CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY,
IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND
SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and
following the public notice and hearing procedures as required in Section 10- 03 -03, Caldwell Municipal
Code, approved Case No. ZON -61 -08 (C &MP Properties) at a public hearing held December 1, 2008.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be rezoned to R -3 (High Density Residential) zone:
A portion of the NE % NE % SE % of Section 22, Township 4 North, Range 3 West, Boise Meridian,
Caldwell City, Canyon County, Idaho.
Commencing at the E % corner of Section 22, being the centerline of Hillcrest Street and the centerline of
North Indiana Avenue; thence S 89 °29'24" W, 25.00 feet along the centerline of Hillcrest Street to the
POINT OF BEGINNING; thence S 00 0 16'06" E, 25.00 feet to the NE corner of Lot 1, Block 1 of Hoff
Addition No. 1 Subdivision, as shown on the official plat thereof on file in records of the Canyon Count,
Idaho, as Instrument No. 309094; thence S 89 °29'24" W, 131.12 feet along the northerly boundary of said
Lot 1 to the NW corner of said Lot 1; thence S 00 0 16'06" E, 115.91 feet along the westerly boundary of
said Lot 1 to the SW corner of said Lot 1; thence S 89 0 29'24" W, 16.00 feet to the easterly boundary of
Lot 6, Block 1 of said Hoff Addition No. 1 Subdivision; thence S 00 0 16'06" E, 33.97 feet along the easterly
boundary of said Lot 6 to the SE corner of said Lot 6; thence S 89 0 29'24" W, 131.12 feet along the
southerly boundary of said Lot 6 to the SW corner of said Lot 6; thence S 00 0 16'06" E, 47.99 feet along
the westerly boundary of Lot 5 of said Block 1 to the northeasterly right -of -way of State Highway 1 -84;
thence continuing along said northeasterly right -of -way of Interstate 1 -84 the following courses and
distances: N 57 0 07'31" W, 199.42 feet; 134.30 feet along a non - tangent curve deflecting to the right
having a radius of 723.98 feet, a central angle of 10 0 37'44 ", a chord bearing of N 32 59' 27" W, and a
long chord distance of 134.11 feet to a point on the centerline of Hillcrest Street, as shown on said plat of
Hoff Addition No. 1 Subdivision; thence leaving said northeasterly right -of -way of Interstate 1 -84 N 89
29'24" E, 517.72 feet along said centerline of Hillcrest Street to the POINT OF BEGINNING. Said parcel
contains 1.40 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell, Idaho as R -3 (High Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.

Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
