AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN rig-EIITY t IMITS OF THE co
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THEM SAID-LANDS SHOULD
BE REZONED TO THE C-2 (COMMUNITY COMMERCIAL) ZONE; DETERMINING THAT SAID
CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY,
IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND
SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF

Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and c�
following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal c
Code, approved Case No. ZON-54-07 (Bennett Forest Rezone) at a public hearing held, February 4, r
2008.

Section 2. The parcel is located south of 106 Ustick Road in the City of Caldwell, Idaho and the applicant
has requested that said following described property should be rezoned to C-2 (Community Commercial)
zone: c

A portion of the Government Lot 1, located in the NE 1/4 of Section 4, Township 3 North, Range 3 West,
Boise Meridian, City of Caldwell, Canyon County, Idaho, being more particularly described as follows:
COMMENCING at the N % corner of said Section 4, from which the NE section corner of said Section 4
bears S 89°57'33" E, 2,664.36 feet; thence S 89°57'33" E, 1,332.25 feet along the northerly boundary of
said Section 4 and along the centerline of Ustick Road to the NW corner of said Government Lot 1, which
is the POINT OF BEGINNING; thence S 00°06'07" E, 660.06 feet along the westerly boundary of said
Government Lot 1; thence N 89°57'29" E, 247.01 feet; thence N 00°06'07" W, 290.06 feet; thence
S89°57'29"W, 217.00 feet; thence N 00°06'07" W, 370.00 feet to the northerly boundary of said
Government Lot 1 and to the centerline of Ustick Road; thence N 89°57'33" W, 30.01 feet along the
northerly boundary of said Government Lot 1 and along the centerline of Ustick Road to the POINT OF
BEGINNING. Said parcel contains 1.90 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell, Idaho as C-2 (Community Commercial).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 2714 - REVISED
REGARDING ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for the rezone of a parcel of land in the City of Caldwell as C-2 (Community
Commercial).
A portion of the Government Lot 1, located in the NE 1/4 of Section 4, Township 3 North, Range 3 West,
Boise Meridian, City of Caldwell, Canyon County, Idaho, being more particularly described as follows:
COMMENCING at the N 1/4 corner of said Section 4, from which the NE section corner of said Section 4
bears S 89°57'33" E, 2,664.36 feet; thence S 89°57'33" E, 1,332.25 feet along the northerly boundary of
said Section 4 and along the centerline of Ustick Road to the NW corner of said Government Lot 1, which
is the POINT OF BEGINNING; thence S 00°06'07" E, 660.06 feet along the westerly boundary of said
Government Lot 1; thence N 89°57'29" E, 247.01 feet; thence N 00°06'07" W, 290.06 feet; thence

The Ordinance includes a provision to amend the official maps of the City by designating the above-
described property as C-2 and providing an effective date, which shall be when published in the Idaho
Press Tribune on the 10th day of March 2008. Ordinance No. 2714 was passed by the Council and
approved by the Mayor on the 3rd day of March 2008. The full text of the Ordinance is available at
Caldwell City Hall, 411 Blaine Street, Caldwell, Idaho. The Mayor and City Council approved the
foregoing summary for publication pursuant to Idaho Code 63-215 on the 3rd day of March 2008.
