HomeMy WebLinkAboutORD 2655INSTRUMENT% BILL NO. 4 ORDINANCE NO, 2655 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63- 215. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning & Zoning, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 1451, approved Case No. ANN - 145 -07 (Dyver Development Annexation by Land Pro Development, a portion of Quail Ridge) at a public hearing geld April 3, 2007. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as R- 1(Single Family Residential): A parcel of land located in the SE % of Section 10, Township 3 North, Range 3 West, Boise Meridian, City of Caldwell, Canyon County, Idaho, more particularly described as follows; COMMENCING at the Center'/ corner of said Section 10; thence South 00 0 22'02" West a distance of 315.10 feet coincident with the Westerly line of said SE % of Section 10 to the Northwesterly corner of Quail Ridge Subdivision Phase 1 (Instrument No. 200692355, Canyon County Records); thence along the Northerly boundary of said Quail Ridge Subdivision Phase 1 as follows: North 89 0 53'58" East, 109.24 feet; thence North 49 °30'25" East, 343.74 feet to the centerline of the Deer Flat Caldwell Canal; thence along said centerline of the Deer Flat Caldwell Canal and continuing along said Northerly boundary of Quail Ridge Subdivision Phase 1 as follows: South 54 0 29'32" East 31.20 feet; thence South 52 0 33'41" East, 122.81 feet; thence South 45 °08'33" East, 42.00 feet; thence South 32 "25'10" East, 61.38 feet; thence South 21 °59'58" East, 70.73 feet; thence South 25 °38'28" East, 75.36 feet; thence South 32 °06'00" East, 76.52 feet; thence South 42 °05'42" East, 77.73 feet; thence South 49 0 22'58" East, 1.39 feet to the POINT OF BEGINNING; thence leaving said centerline of the Deer Flat Caldwell Canal North 44 0 57'12" East, a distance of 742.75 feet along said Northerly boundary of Quail Ridge Subdivision Phase 1 to a point on the Northerly line of said SE % of Section 10; thence North 89 0 52'12" East, a distance of 55.46 feet along said Northerly line of the SE % of Section 10; thence South 44 °57'12" West, a distance of 779.05 feet parallel with and offset 39.16 feet Southeasterly from said Northerly boundary of Quail Ridge Subdivision Phase 1 to the centerline of said Deer Flat Caldwell Canal; thence North,49 °22'58" West, 39.27 feet along the centerline of the Deer Flat Caldwell Canal to the POINT OF BEGINNING. Said parcel contains 0.68 acres, more or less. Section 3. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R -1 (Single Family Residential). Section 4.
