ORDINANCE NO. 2660
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE
FAMILY RESIDENTIAL) ZONE DISTRICT; DECLARING SAID LANDS BY PROPER LEGAL
DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO
ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO;
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED
COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY,
STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE,
SECTION 63 -215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner, and
following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No.
1451, approved Case No. ANN - 142 -06 (Klamath Falls Sub.) at a public hearing held March 19, 2007.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R -1 (Single Family
Residential):
A parcel located in the N '/2 SW % of Section 12, Township 3 North, Range 3 West, Boise Meridian,
Canyon County, Idaho and more particularly described as follows:
BEGINNING at the NW corner of said N'/ SW %; thence N 89 0 23'15" E a distance of 1543.27 feet along
the Northerly boundary of said N' /2 SW '/ to a point on the centerline of Wilson Creek Drain; thence
leaving said Northerly boundary S 11 0 03'04" E a distance of 929.50 feet along said Wilson Creek Drain
centerline; thence continuing along said centerline S 14 0 17'09" E a distance of 420.38 feet to a point on
the Southerly boundary of said N ' /2 SW %; thence leaving said centerline S 89 0 20'52" W a distance of
1021.72 feet along said Southerly boundary; thence leaving said Southerly boundary N 0 0 51'06" E a
distance of 251.80 feet; thence N 89 0 49'59" W a distance of 503.34 feet; thence S 88 °23'36" W a
distance of 316.29 feet to a point on the Westerly boundary of said N'/2 SW %*, thence N 0 0 39'34" E a
distance of 1070.48 feet along said Westerly boundary to the POINT OF BEGINNING. This parcel
contains 46.33 acres.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell, Idaho as R -1 (Single Family Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
