ORDINANCE NO. 2646
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE
FAMILY RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID
PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF
IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-
215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Plarining & Zoning, and
following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No.
1451, approved Case No. ANN- 140 -06 (Mandalay Ranch Annexation) at a public hearing held February,
20, 2007.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R -1 (Single - Family
Residential):
A parcel of land being a portion of the SE Y4 of Section 19, Township 4 North, Range 2 West, Boise
Meridian, Canyon County, Idaho, being more particularly described as follows:
COMMENCING at the NE corner of the SE % (East % corner) of Section 19 the REAL POINT OF
BEGINNING; thence S 00 °34'09" W 2119.13 feet to a point on the Northerly right -of -way line of the
Mason Creek Drain, as shown on Record of Survey Instrument Number 200667023 at the Canyon
County Recorder's Office; thence along the said Northerly right -of -way line the following eight (8) courses:
N 75 °02'56" W 206.63 feet; thence N 67 0 24'07" W 141.43 feet; thence N 63 0 29'33" W 202.64 feet; thence
N 77 0 39'52" W 162.55 feet; thence N 89 0 29'17" W 149.93 feet; thence N 86 °29'03" W 164.99 feet; thence
N 89 °08'23" W 331.62 feet; thence S 00 0 34'50" W 55.00 feet to a point on the centerline of said Mason
Creek Drain; thence along said centerline the following seven (7) courses: N 89 °25'10" W 130.66 feet to a
point of curvature; thence 303.02 feet along a curve to the right, said curve having a radius of 229.20 feet,
a delta angle of 75 °45'04 ", a tangent of 178.27 feet, and a chord bearing N 51 °32'38" W 281.43 feet to a
point of tangency; thence N 13 W 445.97 feet; thence N 14 0 31'57" W 108.28 feet; thence N
38 0 07'27" W 143.58 feet; thence N 38 °11'27" W 604.01 feet; thence N 38 0 07'23" W 575.55 feet to a point
on the West line of said SE % of Section 19; thence leaving said centerline of the Mason Creek Drain S
89 0 46'43" E 280.00 feet; thence N 00 °35'20" E 180.00 feet to a point on the North line of said SE % of
Section 19; thence S 89 °46'43" E 2357.29 feet to the REAL POINT OF BEGINNING. Said parcel
contains 91.07 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell, Idaho as R -1 (Single - Family Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repeated,
rescinded and annulled.
