HomeMy WebLinkAboutORD 2644INSTRUMENT NO.Z0074X�7 BILL NO. 69 ORDINANCE NO. 2644 • AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63- 215. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning & Zoning, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 1451, approved Case No. ANNA 38 -06 (Grace Community Church dba Living Waters Worship Center) at a public hearing held April 3, 2007. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as R -1 (Single Family Residential): A parcel of land situated in the NE % SE '/ of Section 4, Township 3 North, Range 3 West, Boise Meridian, Canyon County, Idaho, being a portion of Lot 20 of ORCHARD HEIGHTS SUBDIVISION, Book 2 of Plats at Page 38, records of Canyon County, Idaho, and being more particularly described as follows: COMMENCING at the SE comer of the NE'/ SE %; thence North 00 21' 53" West, 25.00 feet along the East line of said NE % SE %; thence South of 89 06' 52" West, 25.00 feet parallel with the South line of said NE % SE '/4 to the SE corner of said Lot 20; thence North 00 21' 53" West, 638.17 feet along the East line of said Lot 20 to the NE corner of said Lot 20; thence South 89 06' 13" West, 233.01 feet along the North line of said Lot 20 to the POINT OF BEGINNING; thence South 00 21' 53" East, 208.01 feet parallel with the aforesaid East line of Lot 20; thence North 89 06' 13" East, 258.01 feet parallel with the aforesaid North line of Lot 20 to a point on the aforesaid East line of said NE % SE %; thence South 00 21' 53" East, 240.16 feet along the said East line of the NE % SE % thence South 89 08' 52" West, 657.74 feet; thence North 00 20' 54" West, 448.04 feet along a line parallel with and 8 feet East of the West line of said Lot 20 to a point on the aforesaid North line of Lot 20; thence North 89 06' 13" East, 399.60 feet along the said North line of Lot 20 to the POINT OF BEGINNING. Said parcel contains 5.53 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R -1 (Single Family Residential). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5.
