ORDINANCE NO. 2635
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE
FAMILY RESIDENTIAL) ZONE DISTRICT; DECLARING SAID LANDS BY PROPER LEGAL
DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR
TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO;
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED
COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY,
STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE,
SECTION 63 -215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner, and
following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No.
1451, approved Case No. ANN - 133 -06 (Marble Heights) at a public hearing held January 16, 2007 and
February 5, 2007.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R -1 (Single - Family
Residential):
This parcel is a portion of the NE % NW % of Section 23, Township 4 North, Range 3 West, Boise
Meridian, Canyon County, Idaho and is more particularly described as follows:
BEGINNING at the SE corner of said NE % NW %; thence N 89 0 25'12" W, 388.09 feet along the South
boundary of said NE % NW % to the SE corner of a parcel described in Instrument No. 8518030 on file in
the Office of the Recorder, Canyon County; thence N 00 0 06'47" E, 213.28 feet (of record 213.22 feet)
along the East boundary of said parcel described in Instrument No. 8518030 to the NE corner of said
parcel described in Instrument No. 8518030; thence N 89 0 24'17" W, 273.93 feet (of record 274.08 feet)
along the North boundary of said parcel described in Instrument No. 8518030 to a point on the West
boundary of a parcel as described in Instrument No. 9915868; thence N 00 0 08'19" E. 492.12 feet (of
record 492.09 feet) along said West boundary to the NW corner of said parcel described in Instrument
No. 9915868; thence N 89 0 49'30" E, 662.10 feet (of record 662.11 feet) along the North boundary of said
parcel described in Instrument No. 9915868 to a point on the East boundary of said NE % NW %, which
lies 623.82 feet South of the NE corner of said NE % NW '/; thence S 00 1, 08'19" W, 714.20 feet along
said East boundary of the NE % NW % to the TRUE POINT OF BEGINNING. Said parcel contains 9.45
acres, more or less.
Section 3. That the City Engineer and the Community Development Director of the City of Caldwell,
Idaho, are hereby instructed to so designate the same above described property on the official zoning
map and other area maps of the City of Caldwell, Idaho as R -1 (Single - Family Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
