ORDINANCE NO. 2633
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE
ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY RESIDENTIAL)
ZONE DISTRICT; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO
BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES,
RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; DIRECTING THE CITY ENGINEER
AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE
CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A
CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON
COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE,
SECTION 63 -215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner, and following
the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 1451, approved Case
No. ANN - 131 -06 (Eagle Rock) at public hearings held November 20, 2006 and December 4, 2006.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said
following described property should be annexed into the City of Caldwell as R -1 (Single - Family Residential):
A parcel of land located in the E %a of Section 20, the E %a NW % of Section 20, and the S' /2 SW 1 14 of Section 21,
Township 4 North, Range 2 West, B.M., Canyon County, Idaho, and more particularly described as follows:
BEGINNING at the corner common to Sections 20, 21, 28, and 29, Township 4 North, Range 2 West, B.M.; thence
North 89 °36'45" West, 1253.25 feet along the South line of the SE % of said Section 20 to the intersection with the
Northeasterly right -of -way of the Idaho Northern Railroad; thence North 18 °46'57" West, 203.58 feet along said
Northeasterly line to the intersection with the West line of the SE '/ SE % of said Section 20; thence North
00 °52'16" East, 743.30 feet; thence South 71 °13'03" West, 250.00 feet to the intersection with the said
Northeasterly right -of -way of the Idaho Northern Railroad; thence North 18 0 46'57" West, 2615.16 feet along said
Northeasterly right -of -way to the intersection with the Southerly right -of -way of Five Mile Drain, as described in
Quitclaim Deed Instrument No. 71014, records of said Canyon County; thence South 71 West, 100.00 feet to
the intersection with the Southwesterly right -of -way of the Idaho Northern Railroad; thence North 18 0 46'57" West,
152.30 feet along said Southwesterly right -of -way to the intersection with the Northerly right -of -way of the Five Mile
Drain as described in Quitclaim Deed Instrument No. 70913, records of said Canyon County; thence along said
Northerly right -of -way the following courses and distances: North 58 °35'40" West, 392.08 feet to the beginning of a
curve to the left; thence along said curve to the left an arc distance of 119.81 feet, said curve having a radius of
176.20 feet, a central angle of 38 °57'33", and a chord bearing and distance of North 78 0 36'53" West, 117.52 feet;
thence South 81 °54'20" West, 514.41 feet; thence North 86 °20'40" West, 435.58 feet to the intersection with the
West line of the E Ma NW % of said Section 20; thence North 00 0 37'37" East, 1393.81 feet leaving said Northerly
right -of -way and along said West line to the intersection with the North right -of -way line of Lincoln Road as
described in Affidavit of Survey recorded as Instrument No. 753842, records of said Canyon County; thence North
84 °05'53" East, 101.38 feet along said North right -of -way; thence South 86 °46'52" East, 753.41 feet continuing
along said North right -of -way to the intersection with the Northwesterly extension of the said Southwesterly right -of-
way of Idaho Northern Railroad; thence South 18 0 47'27" East, 1117.84 feet along said Northwesterly extension and
said Southwesterly right -of -way; thence South 18 °46'57" East, 513.80 feet continuing along said Southwesterly
right -of -way to the intersection with the afore said Northerly right -of -way of Five Mile Drain;
thence North 71 0 13'03" East, 100.00 feet to the intersection with the Northeasterly right -of -way of Idaho Northern
Railroad; thence South 18 0 46'57" East, 152.30 feet along said Northeasterly right -of -way to the intersection with the
afore sold Southerly right -of -way of Five Mile Drain; thence along said Southerly right -of -way of the Five Mile Drain
the following courses and distances: South 64 °10'40" East, 219.91 feet to the beginning of a curve to the left;
thence along said curve to the left an arc distance of 234.27 feet, said curve having a radius of 653.70 feet, a
