ORDINANCE NO. 2632
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY
LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT
SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF
THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONE DISTRICT; DECLARING SAID LANDS BY
PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; DIRECTING THE CITY
ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE
OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF
THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF
THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO
STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing
Examiner, and following the public notice and hearing procedures set forth in Section 10- 01 -07,
Zoning Ordinance No. 1451, approved Case No. ANN - 132 -06 (Peregrine Estates) at a public
hearing held April 3, 2007.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has
requested that said following described property should be annexed into the City of Caldwell as
R -1 (Single - Family Residential):
Situated in the W '/ of Section 13, Township 3 North, Range 3 West, Boise, Meridian, Canyon
County, Idaho, more particularly described as follows:
Commencing at the SW corner of the SW % NW % of Section 13 (West % corner), T. 3N., R.
3W., B.M., Canyon County, Idaho; thence North 00 0 06'53" East, 1320.89 feet along the West line
of the SW Y NW % of said Section 13 to the NW corner of said SW % NW %, the POINT OF
BEGINNING; thence North 88 0 51'42" East, 2330.91 feet along the North line of said SW % NW
to a point on the centerline of the Upper Embankment Drain; thence South 06 0 38'54" East,
2259.74 feet along said centerline; thence South 89 °00'00" West, 1266.86 feet to a point on the
East line of the NW % SW %; thence South 00 0 08'03" West, 399.58 feet along said East line of
the NW % SW % to the SE corner of said NW % SW %, thence North 89 0 00'00" East, 473.43 feet
along the North line of the SE % SW %; thence South 00 °56'24" East, 1323.69 feet to a point on
the South line of said SW %; thence South 89 °03'11" West, 689.79 feet along said South line;
thence North 00 °57'07" West, 435.60 feet; thence South 89 °03'11" West, 200.00 feet; thence
North 00 0 57'07" West, 867.27 feet to a point 20 feet South of the North line of said SW % SW %;
thence South 89 0 00'00" West, 912.08 feet along a line 20 feet South of and parallel with said
North line to a point on the West line of the SW % NW %; thence North 00 °02'44" East, 1342.22
feet along said West line of the SW % NW % to a point on the North line of said NW '/ SW %;
