ORDINANCE NO. 2629
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE
FAMILY RESIDENTIAL) ZONE DISTRICT; DECLARING SAID LANDS BY PROPER LEGAL
DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR
TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO;
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED
COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY,
STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE,
SECTION 63 -2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning
Ordinance No. 1451, approved Case No. ANN - 129 -06 (Stewart/White Pine Annexation) at a public
heating held November 6, 2006 and November 20, 2006.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R -1 (Single - Family
Residential):
Situated in portions of the NE % and the SE % of Section 29, Township 4 North, Range 2 West B.M.,
Canyon County, Idaho, described as:
BEGINNING at a point that is South 0 0 08'52" East 1325.70 feet along the Section line from the NE corner
of said Section 29, said point being the NE corner of the SE % NE % of said Section 29; thence South
00 11 08'52" East 1185.39 feet along the East line of said Section 29 to the centerline of the Highline Canal;
thence along said centerline the following three courses: North 88 0 33'51" West 135.58 feet; thence North
83 11 22'11 "West 308.87 feet; thence North 88 11 03'42" West 56.64 feet to the Westerly right -of -way of the
Idaho Northern Railroad; thence South 19 0 21'45" East 1514.80 feet along said Westerly right -of -way to
the East line of said Section 29; thence South 00 0 08'02" East 124.74 feet along said East Section line;
thence North 88 0 58'21" West 1320.61 feet to the West line of the SE % SE % of said Section 29; thence
North 00 °09'14" West 17.79 feet along said West line to the SW corner of the NE % SE 1 14 of said Section
29; thence South 89 0 45'37" West 1320.34 feet along the South line of the NW % SE % of said Section 29
to the SW corner of said NW % SE %,, thence North 00 1 1 10'26" West 2652.74 feet along the North -South
centerline of said Section 29 to the NW corner of the SW % NE % of said Section 29; thence North
89 11 47'29" East 1321.23 along the North line of said SW % NE % to the NW corner of the SE % NE % of
said Section 29; thence North 89 11 47'32" East 1321.00 feet along the North line of said SE % NE % to the
POINT OF BEGINNING. Said parcel contains 153.88 acres, more or less.
Section 3. That the City Engineer and the Community Development Director of the City of Caldwell,
Idaho, are hereby instructed to so designate the same above described property on the official zoning
map and other area maps of the City of Caldwell, Idaho as R -1 (Single Family Residential),
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
