AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL,COUNTY OF CANYON,STATE OF IDAHO,AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL,IDAHO,AS PART OF THE R-1 (SINGLE
FAMILY RESIDENTIAL)ZONE;DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL,CANYON COUNTY,IDAHO;
REPEALING ALL ORDINANCES,RESOLUTIONS,ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH;DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO
ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL,IDAHO;AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY,STATE OF
IDAHO AND THE IDAHO STATE TAX COMMISSION,PURSUANT TO IDAHO CODE,SECTION 63-
2219.
BE IT ORDAINED,BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,COUNTY OF
CANYON,STATE OF IDAHO:
Section 1.That the Caldwell City Council,upon recommendation of the Caldwell Planning &Zoning,and
following the public notice and hearing procedures set forth in Section 10-01-07,Zoning Ordinance No.
1451,approved Case No.ANN-127-06 (Harshman,Houston,IF)Annexation)at a public hearing held on
November 6,2006 and November 20,2006.
Section 2.The parcel is contiguous to the City of Caldwell,Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-1 (Single-Family
Residential):
Situated in NW V*of Section 29 and the SE %of Section 30,Township 4 North,Range 2 West,Boise
Meridian,Canyon County,Idaho,and more particularly described as follows:
BEGINNING at the N %corner of said Section 29 from which the NW corner of said Section 29 bears
North 89°34'15"West,2640.61 feet;thence South 00°24'30"West,1326.20 feet along the North-South
midsection line of said Section 29 to the NE corner of the SE V*NW %of said Section 29;thence South
00*24*30"West,1326.20 feet continuing along said mid-section line to the SE corner of the NW Y*of said
Section 29;thence North 89°38'06"West,1014.69 feet along the Southerly boundary line of the NW %of
said Section 29 to the centeriine of the Mason Creek Drain;thence North 89°38'06"West,1624.88 feet
continuing along said Southerly boundary line to the Vi corner common to said Section 29 and Section 30;
thence South 00°24'47"West,156.00 feet along the East boundary line of said Section 30;thence North
89°46'47"West,1730.65 feet along a line parallel with and 156.00 feet South of the Northerly boundary
line of the SE %of said Section 30 to the centeriine of the Bolton Lateral;thence North 12°02'16"West,
51.53 feet along said lateral centeriine to the beginning of a curve to the left;thence continuing 114.37
feet along said lateral centeriine and the arc of said curve which has a radius of 340.87 feet,a central
angle of 19°13'29"and a long chord of 113.84 feet which bears North 21°39l01"West to a point on said
Northerly boundary line of the SE V*of said Section 30,being also the Southeasterly most corner of
Delaware Park Subdivision No.1 Unit No.7 at The Colonies recorded in Book 37 of Plats at Page 8,
Records of Canyon County,Idaho;thence South 89O46'47B East,1784.52 feet leaving said lateral
centeriine and along said Northerly boundary line to the V*corner common to said Section 29 and Section
30;thence North 00°23109"East,150.00 feet along the West boundary line of said Section 29;thence
South 89*38'06"East,1567.38 feet along a line parallel with and 150.00 feet North of the Southerly
boundary line of the NW %of said Section 29 to the centeriine of said Mason Creek Drain;thence North
20°35'25"West,809.53 feet along said drain centeriine to an angle point in same;thence North 00°08'24"
East 1122 36 feet along said drain centeriine;thence South 89°51'36"East,203.00 feet;thence North
OO°o'8'24"East,291.21 feet;thence North 00°33'28n West,83.04 feet;thence North 00'25'45"East,
200.34 feet;thence North 00°25'45"East,50.00 feet to the North boundary line of the NW Vi of said
Section 29;thence South 89°34'15"East,1167.27 feet along said North boundary line to the POINT OF
BEGINNING.Said parcel contains 88.39 acres,more or less.
Section 3.That the City Engineer and the Community Development Director of the City of Caldwell,
Idaho,are hereby instructed to so designate the same above described property on the official zoning
map and other area maps of the City of Caldwell,Idaho as R-1 (Single-Family Residential).
Section 4.All ordinances,resolutions,orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5.This ordinance shall be in full force and in effect from and after its passage,approval and
publication,according to law.
Section 6.The Clerk of the City of Caldwell,Idaho shall,within 10 days following the effective date of
this ordinance,duly file a certified copy of this ordinance and a map prepared in a draftsman-like manner
plainly and clearly designating the boundaries of the City of Caldwell,including the land herein annexed,
with the following officials of the County of Canyon,State of Idaho,to-wit:the Recorder,Auditor,
Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax
Commission of the State of Idaho,all in compliance with Idaho Code 63-2219.
