Z 666 i V BILL NO. 50 ORDINANCE NO. 2625 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED TO THE C -2 (COMMUNITY COMMERCIAL) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning & Zoning Commission and following the public notice and hearing procedures as required in Section 10- 03 -03, Caldwell Municipal Code, approved Case No. ZON -45 -06 (Strickwerda Mini - Storage) at a public hearing held November 6, 2006. Section 2. This parcel is located at 2813 S. Indiana Avenue, Caldwell, Idaho 83605 and the applicant has requested that said following described property should be rezoned to C -2 (Community Commercial): This parcel consists of a portion of Tracts M and N in the Mountain View Subdivision as shown on the official plat thereof on file in Book 2 of Plats at Page 66 in the Office of the Recorder for Canyon County, Idaho, lying in the NW ' / 4 NW % of Section 35, Township 4 North, Range 3 West of the Boise Meridian, being more particularly described as follows: COMMENCING at the SW comer of said NW ' / 4 NE %; thence North 0 °08'27" West a distance of 25.00 feet along the centerline of Indiana Avenue; thence North 89 0 31'09" East a distance of 30.00 feet parallel with the centerline of Cherry Street to the SW corner of said Tract N; thence North 0 0 08'27" West a distance of 166.17 feet along the West boundary of said Tract N to the POINT OF BEGINNING; thence North 0 0 08'27" West a distance of 134.17 feet to the SW corner of said Tract M; thence North 89 °30'51" East a distance of 180.00 feet along the South boundary of said Tract M; thence North 0 0 08'27" West a distance of 170.35 feet parallel with the West boundary of said Tract M to a point which lies on a line 130.00 feet Southerly from and parallel with the North boundary of said Tract M; thence North 89 0 30'32° East a distance of 451.72 feet along said parallel line to a point on the East boundary of said Tract M; thence South 0 °09'55" East a distance of 320.59 feet along the East boundary of Tracts M and N to the SE corner of the N' /x of Tract N; thence South 89 °31'00" West a distance of 481.91 feet along the South boundary of the N '/s of Tract N to a point which lies on a line 149.95 feet East of and parallel with the West boundary of said Tract N; thence North 0 0 08'27" West a distance of 16.00 feet along said parallel line; thence South 89 °31'00" West a distance of 149.95 feet parallel with the South boundary of the N '/Y of said Tract N to the TRUE POINT OF BEGINNING. Said parcel contains 3.89 acres, more or less. Section 3. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as C -2 (Community Commercial). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law.
