HomeMy WebLinkAboutORD 2623BILL No. 48 ORDINANCE No. 2623 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL PURSUANT TO IDAHO CODE § 67 -6518 AMENDING "CITY OF CALDWELL SUPPLEMENTAL SPECIFICATIONS TO THE 2006 IDAHO STANDARDS FOR PUBLIC WORKS CONSTRUCTION" STANDARDS FOR PUBLIC AND PRIVATE DEVELOPMENT; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT HEREWITH. WHEREAS, the City has adopted the 2006 Idaho Standards For Public Works Construction for application in public and private Development within the City; and WHEREAS, the City has adopted certain supplemental modifications to said standards pursuant to previously adopted Bill No. 6, Ordinance No. 2541; and WHEREAS, one the supplemental provisions limits the types of light poles and light fixtures that can be used in connection with the construction of street lighting; and WHEREAS, such limitations exist for the efficiency and economy of the City who accepts such light poles in dedication and assumes the responsibility for their perpetual maintenance and operation. Limiting the number of available light poles and fixture types reduces the need for the City to maintain a wide variety of replacement parts and eliminates diverse repair and maintenance variety; and WHEREAS, the City is amenable to a broader variety of street lights and fixtures for developments that intend to create a unique sense of place through decorative street lighting where the proposed street lights, though different from those otherwise set forth in the approved supplemental standards, still provide necessary public health, safety and welfare illuminate and quality and will be maintained by a local homeowners association, not the City. BE IT ORDAINED by the Mayor and City Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1: That the CITY OF CALDWELL SUPPLEMENTAL SPECIFICATIONS TO THE 2003 IDAHO STANDARDS FOR PUBLIC WORKS CONSTRUCTION prepared in March 2003 and adopted as a legislative matter on or about ordinance by Bill No. 6 Ordinance No. 2541, is hereby amended to provide, generally, as follows: Section 1102 of the Idaho Standards for Public Works Construction concerning "Street Lighting" shall be amended to allow broad flexibility in the selection and installation of decorative street light poles and fixtures.
