HomeMy WebLinkAboutORD 2611U V � t F - Z' i_i rNT NO, eWft'� 1�5 1 � - BILL NO. 36 ORDINANCE NO. 2611 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONE DISTRICT; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 2589, approved Case No. ANN - 122 -06 (Marble Creek) at a public hearing held July 11, 2006. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as R -1 (Single - Family Residential) zone: A Parcel of land located in portion of the S % NE '/4 and a portion of the N %s SE '/4 of Section 24, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho and described as follows: BEGINNING at the NE corner of said S '/4 NE %; thence along the East line of said S ' /3 NE % South 00 °02 West a distance of 863.90 feet; thence leaving said East line North 89 0 57'10" West a distance of 195.00 feet; thence South 00 0 02'50" West a distance of 230.00 feet; thence South 89 0 57'10" East a distance of 195.00 feet to a point on said East line; thence along said East line South 00 °02'50" West a distance of 229.54 feet to the SE corner of said S' /2 NE 1 14; thence leaving said East line and along the South line of said S' /2 NE 1 /4 South 88 0 54'20" West a distance of 1420.00 feet to a point on the centerline of the Solomon Slough Drain; thence along said centerline the following courses: South 64 0 27'00" East a distance of 158.00 feet; thence South 36 0 01'20" East a distance of 742.00 feet; thence South 06 °34'08" East a distance of 212.24 feet; thence South 05 0 55'30" East a distance of 254.82 feet; thence South 02 0 17'40" East a distance of 180.16 feet to a point on the South line of said N ' /2 SE % ; thence leaving said centerline and along said South line South 88 °50'48" West a distance of 1863.45 feet to the SW comer of said N' /2 SE 1 /4; thence leaving said South line and along the West line of said N' /2 SE % North 00 0 09'07" West a distance of 1326.61 feet to the NW corner of said N %, SE ' /4; thence along the West line of said S' /2 NE % North 00 0 10'03" West a distance of 884.32 feet to a point on said centerline of the Solomon Slough Drain; thence along said centerline the following courses: South 68 ° 41'31" East a distance of 160.00 feet; thence South 57 0 35'44" East a distance of 238,59 feet; thence leaving said centerline North 00 0 10'03" West a distance of 632.00 feet to a point on the North line of said S' /2 NE 1 /4; thence along said North line North 88 °54'46" East a distance of 2305.06 feet to the POINT OF BEGINNING. Said parcel contains 126.96 acres, more or less. Section 3. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R -1 (Single - Family Residential) zone.
