ORDINANCE NO. 2605
AN ORDINANCE DETERMINING THAT CERTAIN LANDS LAY CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINDLE
FAMILY RESIDENTIAL) AND C -1 (NEIGHBORHOOD COMMERCIAL) ZONES; DECLARING SAID
LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY
OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; DIRECTING THE CITY ENGINEER AND
COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF
THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO
FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH
CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO
IDAHO CODE, SECTION 63 -2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning
Ordinance No. 2586, approved Case No. ANNA 19 -06 (Bishop Ranch) at a public hearing held June 19,
2006.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as follows:
R -1 (Sinole Family Residential) zone:
A Parcel of land being a portion of Section 19, Township 4 North, Range 2 West, Boise Meridian, Canyon
County, Idaho and described as follows:
BEGINNING at the NW corner of the N '/2 NE % of said Section 19; thence along said North line North
89 °38'59" East a distance of 1609.61 feet; thence leaving said North line and along the arc of a non
tangent curve to the right, of which the radius point lies South 00 0 09'53" West, a radial distance of 600.00
feet and having a chord bearing of South 64 0 17'09" East, 517.55 feet; thence Southeasterly along the arc,
through a central angle of 51 a distance of 535.11 feet to a point; thence along the arc of a
reverse curve to the left, having a radius of 600.00 feet, an arc length of 540.49 feet, a central angle of
51"36'46", and a chord bearing South 64 0 32'34" East a distance of 522.40 feet; thence North 89 0 39'03"
East a distance of 89.41 feet to a point on the East line of said N % NE %; thence along said East line
South 00 0 02'42" East a distance of 866.32 feet to the SE corner of said N '/z NE %; thence leaving said
East line and along the South line of said N '/ NE % South 89 0 38'01" West a distance of 1977.95 feet to
the NE corner of the W Y2 SW '/ NE % of said Section 19; thence along the East line of said W '/ SW %
NE % South 00 0 01'54" East a distance of 1,057.65 feet; thence leaving said East line South 89 °36'44"
West a distance of 330.00 feet; thence South 00 0 01'54" East a distance of 264.00 feet to the South line of
said W '/ SW % NE %; thence along said South line South 89 °36'44" West a distance of 329.32 feet to
the SW corner of said W '/ SW % NE %; thence along the West line of said W '/ SW % NE % North
00 0 01'30" West a distance of 660.88 feet to the SE corner of the N '/ SE % NW % of said Section 19;
thence along the South line of said N'/ SE % NW % South 89 °37'44" West a distance of 1,314.60 Feet to
the SW corner of said N % SE % NW %a; thence along the West line of said N '/s SE % NW % North
00 °08'11" West a distance of 661.62 feet to the SW corner of the NE % NW % of said Section 19; thence
along the West line of said NE % NW % North 00 0 07'44" West a distance of 929.85 feet to a 518 inch
rebar; thence leaving said West line parallel with the North line of said NE % NW % North 89 0 39'15" East
a distance of 200.00 feet to a 518 inch rebar; thence parallel with said West line North 00 0 07'44" West a
distance of 392.00 feet to a 518 inch rebar on said North line; thence along said North line North 89 °39'15"
East a distance of 1,118.28 feet to the POINT OF BEGINNING.
