ORDINANCE NO. 2604
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (LOW
DENSITY RESIDENTIAL) ZONE DISTRICT; DECLARING SAID LANDS BY PROPER LEGAL
DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF
IN CONFLICT HEREWITH; DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT
DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL,
IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY
OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE
OF IDAHO, AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION
63 -2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning
Ordinance No. 2586, approved Case No. ANN - 118 -06 (Bear Ridge) at a public hearing held July 17,
2006.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as an R -1 (Low Density
Residential) zone:
A Parcel of land located in the S' /a NE'/ of Section 4, Township 3 North, Range 3 West, Boise Meridian,
Canyon County, Idaho and described as follows:
BEGINNING at the SW corner of said S % NE %; thence along the West line of said S ' / 2 NE % North
00 0 12'44" West a distance of 1,325.68 feet to the Northwest corner of said S % NE %; thence leaving said
West line and along the North line of said S'/ NE % North 89 °11'47" East a distance of 635.03 feet to a
point on the centerline of the Phyllis Canal; thence leaving said North line and along said centerline of the
Phyllis Canal the following courses: South 25 °34'22" East a distance of 152.60 feet; thence South
21 East a distance of 88.65 feet; thence Southeasterly a distance of 201.53 feet along the arc of a
non - tangent curve to the left, having a radius of 194.90 feet, a central angle of 59 0 14'44 ", and a chord
bearing of South 52 °22'01" East, 192.67 feet; thence South 81 East a distance of 275.94 feet;
thence Southeasterly a distance of 192.63 feet along the arc of a non - tangent curve to the right, having a
radius of 237.43 feet, a central angle of 46 0 29'01 ", and a chord bearing of South 58 °45'32" East, 187.39
feet; thence South 35 °31'02" East a distance of 26.90 feet; thence South 34 0 40'27" East a distance of
784.54 feet; thence South 34 °03'23" East a distance of 203.85 feet to a point on the South line of said S
'/ NE '/; thence leaving said centerline and along said South line South 89 0 13'54" West a distance of
1891.26 feet to the POINT OF BEGINNING.
Said parcel contains 40.60 acres, more or less.
Section 3. That the City Engineer and the Community Development Director of the City of Caldwell,
Idaho, are hereby instructed to so designate the same above described property on the official zoning
map and other area maps of the City of Caldwell, Idaho as R -1 (Low Density Residential) zone.
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
