ORDINANCE NO. 2802
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE
FAMILY RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH; DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO
ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF
IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-
2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning
Ordinance No. 2602, approved Case No. ANNA 15 -06 (Jordan Meadows) at a public hearing held June
19, 2006.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as an R -1 (Single- Family
Residential) zone:
A parcel of land being a portion of the SE % of Section 32, Township 4 North, Range 2 West, Boise
Meridian, Canyon County, Idaho, being more particularly described as follows:
BEGINNING at the SE corner of Section 32, T.4 N., R.2 W., B.M.; thence S 89 °48'15" W 1327.84 feet to
the SW corner of the SE % SE % of said Section 32; thence N 00'17'15"W 1327.96 feet to the NW
corner of said SE % SE % (SE 1116) of Section 32; thence S 89 °48'07" W 1325.72 feet to the SW corner
of the NW % SE % (CS 1116) of said Section 32; thence N 00 °12'03" W 1327.87 feet to the NW comer of
the SE % (center %) of said Section 32; thence N 89 0 47'22" E 1323.70 feet to the NW corner of the NE'/
SE %4 (CE 1116) of said Section 32; thence N 89 °48'09" E 294.51 feet along the North line of said NE %
SE % to a point on the centerline of Mason Creek; thence along said centerline as follows: S 34 0 45'34" E
846.33 feet; thence S 47 0 21'53" E 99.20 feet; thence S 56 °25'35" E 577.00 feet to a point on the East line
of said NE' /4 SE Y4; thence leaving said centerline S 00 0 22'46" E 243.00 feet to the SE corner of said NE
% SE % (S 1116) of Section 32; thence continuing S 00 E 277.01 feet along the East line of the SE
%4 SE % of said Section 32; thence S 89 0 48'04" W 250.00 feet; thence S 00 0 22'46" E 825.00 feet; thence
N 89 E 8.26 feet to a point of curvature; thence along a curve to the left 16.30 feet, said curve
having a radius of 20.00 feet, a central angle of 46 °42'29 ", tangents of 8.64 feet, and a chord which bears
N 66 0 26'49" E 15.86 feet to a point of reverse curvature; thence along a curve to the right 96.52 feet, said
curve having a radius of 50.00 feet, a central angle of 110"36'21", tangents of 72.22 feet, and a chord
which bears S 81 E 82.22 feet; thence N 89 0 48'04" E 145.91 feet to a point on the East line of said
SE % SE % of Section 32; thence S 00 0 22'46" E 220.00 feet along said East line to the REAL POINT OF
BEGINNING. Said parcel contains 101.21 acres, more or less.
Section 3. That the City Engineer and the Community Development Director of the City of Caldwell,
Idaho, are hereby instructed to so designate the same above described property on the official zoning
map and other area maps of the City of Caldwell, Idaho as R -1 (Single - Family Residential) zone.
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
