ORDINANCE NO. 2601
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE
FAMILY RESIDENTIAL) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL
DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF
IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY
DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF
CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A
CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON
COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO
CODE, SECTION 63 -2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning
Ordinance No. 1451, approved Case No. ANN - 111 -06 (Elevation 2500) at a public hearing held June 5,
2006,
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as follows:
R -1 (Single Family Residential) zone:
A tract of land situated within the Northeast ' / 4 of Section 12, Township 3 North, Range 3 West, Boise
Meridian, Canyon County, Idaho, described as follows: Commencing at a found brass cap monumenting
the Northeast corner of said Section 12, thence Southerly along the Easterly line of said Section and the
center line of Midway Avenue South 01 West a distance of 2643.34 feet to a found brass cap
monument marking the East % corner of said Section 12 and the centerline intersection of said Midway
Avenue and Moss Street and the POINT OF BEGINNING; thence Westerly along the centerline of Moss
Street and the Southerly line of said Northeast % of Section 12, North 89 0 24'25" West a distance of
611.64 feet to the centerline intersection of said Moss Street and the Isaiah Drain; thence Northerly along
the centerline of said Isaiah Drain as follows: North 09 0 29'43" East a distance of 67.49 feet; thence North
10 0 09'43" West a distance of 44.42 feet; thence North 23 0 52'07" West a distance of 61.53 feet; thence
North 27 0 27'18" West a distance of 101.80 feet; thence North 30 0 07'38" West a distance of 155.36 feet;
thence North 30 0 04'57" West a distance of 542.08 feet; thence North 29 0 42'15" West a distance of 199.58
feet; thence North 28 0 01'42" West a distance of 91.92 feet; thence North 12 6 34'05" West a distance of
57.83 feet; thence North 03 °15'41" West a distance of 44.77 feet; thence North 05 °00'40" East a distance
of 43.02 feet; thence North 14 0 33'10" East a distance of 35.48 feet; thence North 26 0 38'38" East a
distance of 37.91 feet; thence North 28 0 03'02" East a distance of 509.05 feet; thence South 75 °39'23"
East a distance of 11.49 feet to the center line intersection of said Isaiah Drain and the Elijah Drain;
thence Southeasterly along the center line of said Elijah Drain as follows: South 62 °15'27" East a
distance of 14.69 feet; thence South 43 0 12'22" East a distance of 161.90 feet; thence South 45 °44'01"
East a distance of 170.13 feet; thence South 42 °48'44" East a distance of 265.49 feet; thence South
44 0 55'28" East a distance of 596.35 feet; thence South 42 0 50'23" East a distance of 121.77 feet to the
center line intersection of said Elijah Drain and Midway Avenue, said intersection also being a point on
the Easterly line of said Section 12; thence Southerly along said Easterly line South 01 West a
distance of 830.22 feet to the POINT OF BEGINNING. The above- described tract of land contains 29.04
acres more or less.
