HomeMy WebLinkAboutORD 2592ad I N S �R " ; 'A 49 j0pMe- BILL NO. 17 ORDINANCE NO. 2592 REVISED Correcting Instrument No. 200636607 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -3 (HIGH DENSITY RESIDENTIAL) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 2589, approved Case No. ANN - 108 -05 (Eldorado Estates) at a public hearing held February 21, 2006. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as R -3 (High Density Residential) zone: This parcel is situated in a portion in the SE % SW % of Section 34. Commencing at the SE corner of SE % SW %, said corner being the intersection of Ustick Road and Montana Avenue; thence S. 89 20' 30" W., 270.08 feet along the South line of said Section 34 (centerline of said Ustick Road) to the POINT OF BEGINNING; thence continuing S.89° 20' 30" W., 279.75 feet along said South Section line (centerline); thence N.00° 39' 30" W., 268.00 feet; thence S.89 20' 30" W, 73.00 feet; thence S.00° 39'30" E., 108.00 feet; thence S.89° 20'30"W., 73.00 feet; thence S.00 39' 30" E., 115.00 feet; thence N.89° 20' 30" E., 73.00 feet; thence S.00 39' 30" E., 45.00 feet to a point in said South line of Section 34; thence S.89° 20' 30" W., 306.98 feet along said South line (centerline of Ustick Road); thence N.01" 41' 45" E., 390.28 feet to the Southeast corner of Stonegate Subdivision Unit #2; thence N.01' 41' 45" E., 336.62 feet along the East line of said subdivision; thence S.73 31' 38" E., 60.74 feet to a point in the centerline of the Low Line Canal; thence S.64° 35'45" E., 339.97 feet along said canal centerline; thence S.80 28' 25" E., 39.89 feet along said canal centerline; thence N.81* 54' 15" E., 62.03 feet along said canal centerline, thence N.58° 11' 15" E., 30.54 feet along said canal centerline to a point in the approximate centerline of the Yonkee Drain; thence S.20 20' 25" E., 427.77 feet along approximate centerline; thence S.00° 50' 40" W., 173.09 feet to the POINT OF BEGINNING, Said parcel containing 342,457 square feet or 7.862 acres, more or less.
