HomeMy WebLinkAboutORD 2588%004oAl ? 7 a BILL NO. 13 ORDINANCE NO. 2588 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (LOW DENSITY RESIDENTIAL), R -3 (HIGH DENSITY RESIDENTIAL), AND C -2 (COMMUNITY COMMERCIAL) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 2588, approved Case No. ANN - 104 -05 (Dakota Crossing) at a public hearing held January 17, 2006. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as: R -1 (Low Density Residential) zone A portion of the East 112, of the Southwest 114, of Section 12, Township 3 North, Range 3 West, Boise Meridian., Canyon County, Idaho more particularly described as follows: BEGINNING at a point on the East line of said Southwest 114, from which the Southeast corner of said Southwest 114 bears South 00 0 04'33" East a distance of 987.26 feet, thence South 89 °55'27" West a distance of 420.34 feet to a point; thence South 89 °32'57" West a distance of 66.94 feet to a point; thence South 75 °01'48" West a distance of 240.20 feet to a point on the centerline of the Wilson Drain; thence along said centerline the following courses, North 14 0 58'12" West a distance of 394.53 feet to a point; thence North 15 0 05'35" West a distance of 420.38 feet to a point; thence North 11 0 26'35" West a distance of 929.56 feet to a point on the North line of said Southwest 114; thence leaving said centerline and along said North line North 88 °51'36" East a distance of 157.31 feet to a point; thence leaving said North line South 10 °57'41" East a distance of 517.93 feet to a point; thence North 88 ° 51'51" East a distance of 858.00 feet to a point on said East line from which the Northeast corner of said Southwest 114 bears North 00 ° 04 1 33" West a distance of 510.50 feet; thence along said East line South 00 °04'33" East a distance of 1,146.62 feet to the POINT OF BEGINNING. Said Parcel contains 25.045 acres.
