ORDINANCE NO. 2586
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (LOW
DENSITY RESIDENTIAL) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL
DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF
IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY
DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF
CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A
CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON
COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO
CODE, SECTION 63 -2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning
Ordinance No. 2586, approved Case No. ANN - 102 -05 (Montecito Park North #4) at a public hearing held
January 17, 2006.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as an R -1 (Low Density
Residential) zone:
A parcel of land being a portion of the E % NW % NE %, also a parcel of land being a portion of the W 'A
SW % NE %, and also a parcel of land being all of the E'/ SW % NE % of Section 23, Township 4 North,
Range 3 West, Boise Meridian, Canyon County Idaho, more particularly described as follows:
Commencing at Southeast corner of said Section 23 (corner common to Sections 23, 24, 25, and 26),
said corner monumented with a 3 -inch diameter brass disk; thence N. 00 34' 58" E., a distance of
2638.09 feet along the Easterly boundary of the SE % of said Section 23 to the NE corner of said SE %,
(East 114 corner), said corner monumented with a 518 -inch diameter iron pin; thence N. 89 37' 22" W., a
distance of 1331.40 feet along the Northerly boundary of said SE % to the Southeast corner of said E '/
SW % NE % (center East 1116 corner), said corner being the POINT OF BEGINNING and is monumented
with a 518 -inch diameter iron pin; thence N. 89 37' 22" W., a distance of 665.69 feet along the Southerly
boundary of said E'/ SW % NE % to the Southeast corner of said W'/ SW % NE %, (center West East
1164 corner), said corner monumented with a 112 -inch diameter iron pin; thence N. 89 37' 27" W., a
distance of 4.88 feet along the Southerly boundary of said W Y2 SW % NE % to the Southeast corner of
Marble Valley Subdivision No. 2 as on file in Book 30 of Plats at Page 29 in the Office of the Recorder of
Canyon County, Idaho; thence N. 00 42' 44" E., a distance of 1309.26 feet along the Easterly boundary
of said Marble Valley Subdivision No. 2 and along the Easterly boundary of Marble Valley Subdivision No.
1 as on file in Book 29 of Plats at Page 35 in the Office of the Recorder of Canyon County, Idaho, to the
Northeast corner of said Marble Valley Subdivision No. 1, said corner also being the Southwest corner of
said E 'A NW % NE %, (center West North East 1164 corner), and is monumented with a 518 -inch
diameter iron pin; thence N. 00 31' 41" E., a distance of 1334.29 feet along the Westerly boundary of
said E % NW % NE % to the NW corner of said E '/ NW '/ NE %, (West East 1164 corner), said corner
monumented with a 518 -inch diameter iron pin; thence S. 89 43' 29" E., a distance of 662.86 feet along
the Northerly boundary of said E % NW % NE '/ to the NE corner of said E '/ NW % NE %, (East 1116
corner common to Sections 14 and 23), said corner monumented with a 518 -inch diameter iron pin;
thence S. 00 27' 31" W., a distance of 1125.35 feet along the Easterly boundary of said E % NW % NE %
to a point monumented with a 518 -inch diameter iron pin; thence S. 89 56' 12" W., a distance of 105.00
feet parallel with and 205.00 feet Northerly of the Southerly boundary of said E % NW % NE % to a point
monumented with a 518 -inch diameter iron pin; thence S. 00 27' 31" W., a distance of 205.00 feet parallel
