AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE
FAMILY RESIDENTIAL) C -1 (NEIGHBORHOOD COMMERCIAL), AND C -2 (COMMUNITY
COMMERCIAL) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL
DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF
IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY
DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF
CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A
CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON
COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO
CODE, SECTION 63 -2219,
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning
Ordinance No. 1451, approved Case No. ANN - 106 -05 (Sawgrass Village) at a public hearing held
December 13, 2005.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as follows:
R -1 Sin le Family Residential zone:
A parcel of land situated in the SW % of Section 11, Township 3 North, Range 3 West, Boise Meridian,
Canyon County, Idaho, commencing at a 518" iron rod at the NE corner of said SW '/ of Section 11;
thence along the East line of said SW %, said East line also being the centerline of Florida Avenue, South
00 °01'19" East, 645.09 feet to the POINT OF BEGINNING; thence continuing along said East line, South
00 °01'19" East, 908.23 feet; thence South 89 °58'41" West, 364.23 feet to the beginning of a 400.00 foot
radius curve to the left; thence along said 400.00 foot radius curve to the left, through a central angle of
40 0 52'12" (the long chord of which bears South 69 °32'35" West, 279.32 feet) for an arc length of 285.33
feet; thence South 49 °06'29" West, 215.57 feet to the beginning of a 350.00 foot radius curve to the left;
thence along said 350.00 foot radius curve to the left, through a central angle of 33 (the long chord
of which bears South 32 °24'29" West, 201.15 feet) for an arc length of 204.03 feet to the centerline of the
Phyllis Canal; thence along said centerline of the Phyllis Canal, North 47 0 14'13" West, 583.80 feet to the
West line of the SE % of said SW '/; thence along said West line, North 00 0 00'39" West, 220.87 feet to
the NW corner of said SE % SW %; thence along the West fine of the NE % of said SW %, North
00 0 00'39" West, 691.83 feet to a 112" iron rod with yellow plastic cap marked "PLS 4477 "; thence North
89 °39'37° East, 1325.16 feet to the POINT OF BEGINNING. Contains 31.15 acres, more or less.
C -1 (Neighborhood Commercial) zone:
A parcel of land situated in the SW '/ of Section 11, Township 3 North, Range 3 West, Boise Meridian,
Canyon County, Idaho, commencing at a 518" iron rod at the NE corner of said SW % of Section 11;
thence along the East line of said SW %, said East line also being the centerline of Florida Avenue, South
00 °01'19" East, 2603.38 feet to the Northerly right -of -way line of Karcher Road (State Highway 55) as
described in Warranty Deed Instrument No. 200422738, Canyon County Official Records, being 45.00
feet Northerly of the SE corner of said SW %; thence leaving said East line along a line parallel with and
45.00 feet northerly of the centerline of said Karcher Road, South 89 0 06'29" West, 1325.67 to the West
line of the SE '/ of said SW %; thence along said West line, North 00 0 00'39" West, 218.03 feet to the
