ORDINANCE NO. 2547
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY
LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT
SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE
R -1 (SINGLE- FAMILY RESIDENTIAL) ZONE DISTRICT; AND DECLARING SAID LANDS BY
PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY
ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE
OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE
CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE
AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE
TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY
OF CANYON, STATE OF IDAHO;
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and
Zoning Commission, and following the public notice and hearing procedures set forth in Section 10-
01-07, Zoning Ordinance No. 1451, approved Case No. ANN - 100 -04 (Woodgate Subdivision) at a
public hearing held March 7, 2005.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested
that said following described property should be annexed into the City of Caldwell as an R -1 (Single -
Family Residential) zone:
A parcel located in the W Y2 of the SE % of Section 19, Township 4 North, Range 2 West, Boise
Meridian, Canyon County, Idaho, more particularly described as follows:
COMMENCING at a 518 inch diameter iron pin marking the southwest comer of said W '/ of the SE
% (S % corner), from which a 518 inch diameter iron pin marking the southeast corner of the SE % of
said Section 19 bears S 89 °50'28" E a distance of 2638.29 feet;
Thence N 0 0 35'02" E along the westerly boundary of said W % of the SE Y4 a distance of 356.90 feet
to a' /z inch diameter iron pin and the POINT OF BEGINNING;
Thence continuing along said westerly boundary N 0 °35'02" E a distance of 965.51 feet to a PK Nail
and Washer marking the northwesterly corner of the SW % of the SE % of said Section 19;
Thence S 89 °48'38" E along the northerly boundary of said SW % of the SE '/ a distance of 200.69
feet to a 518 inch diameter iron pin;
Thence leaving said northerly boundary S 66 °55'28" E a distance of 163.20 feet to a 518 inch diameter
iron pin;
Thence S 48 °31'04" E a distance of 138.30 feet to a point;
Thence N 29 0 53'06" E a distance of 430.60 feet to a Y2 inch diameter iron pin;
Thence S 88 °15'59" E a distance of 71.64 feet to a point in the centerline of Mason Creek;
