HomeMy WebLinkAboutORD 25400 2 eo,50 7 ?0e BILL NO. 5 ORDINANCE NO. 2540 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE- FAMILY) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 1451, approved Case No. ANN -94 -04 (Heritage Meadows) at a public hearing held January 18 2005. Section 2. The property is located on the southeast corner of Indiana Avenue and Laster Street. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as an R -1 (Single - Family Residential) zone: A PARCEL OF LAND BEING A PORTION OF THE SW 114 OF SECTION 2, TOWNSHIP 3 NORTH, RANGE 3 WEST OF THE BOISE MERIDIAN, CALDWELL, CANYON COUNTY, IDAHO, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHWEST CORNER OF SECTION 2, T.3 N., R.3 W., B.M., THENCE N 00 °34'18" E 747.78 FEET ALONG THE WEST LINE OF THE SW 114 OF SAID SECTION 2 TO THE REAL POINT OF BEGINNING OF THIS DESCRIPTION; THENCE N 00 0 34'18" E 578.58 FEET ALONG SAID WEST LINE TO THE SOUTH 1116 CORNER COMMON TO SECTIONS 2 AND 3; THENCE N 00 °34'04" E 1313.17 FEET ALONG SAID WEST LINE A POINT; THENCE N 89 °39'47" E 377.04 FEET TO A POINT ON THE CENTERLINE OF THE DIXIE DRAIN; ALONG THE CENTERLINE OF THE DIXIE DRAIN THE FOLLOWING; THENCE S 16 °02'37" E 127.54 FEET TO A POINT; THENCE S 25 °04'18" E 1166.89 FEET TO A POINT; THENCE S 18 °44'07" E 324.38 FEET TO A POINT; THENCE S 21 E 437.91 FEET TO A POINT; THENCE S 20 °26'06" E 619.77 FEET TO A POINT; THENCE S 20 0 15'06" E 169.46 FEET TO A POINT ON THE SOUTH LINE OF SAID SECTION 27HENCE S 89'42'14"W 627.84 FEET ALONG SAID SOUTH LINE TO A POINT; THENCE N 20 0 26'06" W 787.73 FEET TO A POINT; THENCE N 89 °28'06" W 562.44 FEET TO THE REAL POINT OF BEGINNING OF THIS DESCRIPTION.
