HomeMy WebLinkAboutORD 2539AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE- FAMILY) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Hearing Examiner, and following the public notice and hearing procedures set forth in Section 10-01 -07, Zoning Ordinance No. 1451, approved Case No. ANN- -89 -04 (Quail Cove) at a public hearing held February 7, 2005. Section 2. The property is located at the northeast intersection of Middleton Road and Ustick Road. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as an R -1 (Single - Family Residential) zone: ZONE: R -1 A parcel of land located in the NW114 of the SW114 of Section 32, TAN., R.2W., B.M., Canyon County, Idaho more particularly described as follows: BEGINNING at a 518" iron pin marking the South 1116 comer of said Section 32 from which W114 corner of said Section 32 bears North 00 °01'27" West, 1325.64 feet; thence along the West boundary line of said Section 32 North 00 1 01'27" West, 619.84 feet to a 5/8" iron pin; thence leaving said West boundary line North 89 °10'13" East, 613.17 feet to a 518" iron pin on the southwesterly bank of the Pioneer "13.3" Lateral, said point also being on a curve to the right; thence along said southwesterly bank the following 7 courses: along said curve 90.07 feet, said curve having a radius of 134.46 feet, a central angle 38 0 22'57" and a long chord of 88.40 feet which bears South 31 0 16'26" East to a 518" iron pin marking the point of tangency; thence South 12 °05'00" East, 241.62 feet to a 518" iron pin marking the beginning of a curve to the left; JAOrdinances & summarylannexationlann89ord.doc 1 c !F— •.�e r17'� '.
