HomeMy WebLinkAboutORD 2537�6 6t-w BILL NO. 2 ORDINANCE NO. 2537 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONE DISTRICT AND C -2 (COMMUNITY COMMERCIAL); AND DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 1451, approved Case No. ANN -91 -04 (Pheasant Run) at a public hearing held January 4, 2005. Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as an R -1 (Single Family Residential) and C-2 (Community Commercial) zone: C -2 ZONE A parcel of land being a portion of Government Lots 3 of Section 30, TAN., R.2W., B.M., Caldwell, Canyon County, Idaho more particularly described as follows: Commencing at the W114 comer of said Section 30 from which the NE comer of said Government Lot 3 bears South 89 0 46'37° East, 1292.22 feet; thence along the North boundary line of said Government Lot 3 South 89 0 46'37° East, 792.24 feet to a point on the centerline of the Solomon Slough Drain; thence along the centerline of the Solomon Slough Drain the following 2 courses: South 32 0 16'08" East, 35.57 feet to the REAL POINT OF BEGINNING; thence continuing South 32 0 16'08° East, 422.32 feet; thence leaving said centerline South 64 0 59'20° West, 137.24 feet; thence North 25 °00'40° West, 113.09 feet to the beginning of a curve to the left; thence along said curve 125.54 feet, said curve having a radius of 228.00 feet, a central angle of 31 and a long chord of 123.96 feet which bears North 40°47'Or West to the point of tangency; thence North 56 West, 128.92 feet to the beginning of a curve to the left; thence along said curve 38.17 feet, said curve having a radius of 228.00 feet, a central angle of 09 and a long chord of 38.13 feet which bears North B1 °21'21" West to the point of reverse curve; thence along said reverse curve 11.58 feet, said curve having a radius of 10.00 feet, a central angle of 66 and a long chord of 10.95 feet which bears North 32 0 57'53" West to the point of tangency; thence North 00 °1323" East, 115.08 feet to the beginning of a curve to the right; thence along said curve 25.88 feet, said curve having a radius of 15.00 feet, a central angle of 98 0 50'28" and a long chord of 22.79 feet which bears North 49 East to the point of tangency; thence South 80°56'09" East, 58.30 feet; thence South 89 01 46'37" East, 99.30 feet to the POINT OF BEGINNING, containing 1.64 acres, more or less. Section 3. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as an R -1 and C-2 (Single Family Residential and Community Commercial ) zone. Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6.
