AN ORDINANCE TO PROVIDE A C -3 (SERVICE COMMERCIAL) ZONE DESIGNATION FOR
CERTAIN LANDS; DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST OF THE CITY
OF CALDWELL, IDAHO; INSTRUCTING THE CITY ENGINEER AND COMMUNITY
DEVELOPMENT DIRECTOR TO DESIGNATE SAID PROPERTY AS C -3 ON THE OFFICIAL
ZONING MAP AND OTHER AREA MAPS OF THE CITY REPEALING ALL LAWS ORDINANCES
AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY
OF CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell upon recommendation
of the Caldwell Planning and Zoning Commission that Case No. ZON- 42 -04, a request by Freehold
Development to rezone certain property, and following the public notice and hearing procedures as
required by Idaho Code, Chapter 65 Local Planning Act, that the following described property be
zoned C -3 (Service Commercial) zone and that said zoning designation is in the best interest of the
City of Caldwell, Idaho.
Section 1. A parcel of land located in the south'/ of the northwest % of the northeast % of Section
25, Township 4 North, Range 3 West, Boise Meridian, City of Caldwell, Canyon County, Idaho, more
particularly described as follows:
THE SOUTH'/ OF THE NORTHWEST'/ OF THE NORTHEAST'/ OF SECTION 25;
EXCEPTING THEREFROM:
COMMENCING at the south Y4 corner of said Section 25, marked by a aluminum cap, as shown on
Record of Survey recorded as Instrument No. 200036080, on file in the office of the Canyon County
Recorder;
Thence North 00 0 40'13" East coincident with the west line of the southwest Y4 of the southeast %, a
distance of 1324.90 feet to the northwest corner of said southwest % of the southeast %;

distance of 1324.89 feet to a 518" rebar marking the northwest corner of said northwest % of the

ALSO EXCEPTING THEREFROM:
All of the S'/ of the northwest Y4 of the northeast'/ of Section 25 lying within the right -of -way of
Smeed Parkway.
The parcel above described contains 11.27 acres more or less.

West, Boise Meridian.
