HomeMy WebLinkAboutORD 2530�.: r /, BILL NO. 44 ORDINANCE NO. 2530 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE- FAMILY RESIDENTIAL) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 1451, approved Case No. ANN -92 -04 (Whitney Springs) at a public hearing held October 18, 2004. Section 2. The property abuts the south side of Ustick Road, approximately 1000 feet east of the Ustick Road and Middleton Road intersection in Caldwell Idaho. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as an R -1 (Single- Family Residential) zone: This parcel is a portion of Government Lot 3 and Government Lot 4 and a portion of the SE NW'/ and the SW % NW % of Section 5, Township 3 North, Range 2 West of the Boise Meridian, Canyon County, Idaho and is more particularly described as follows: BEGINNING at the northeast corner of said Government Lot 3; thence South 00 01'44" East along the east boundary of said Government Lot 3 a distance of 1314.24 feet to the northeast corner of said SE % NW %; thence South 00° 01'44" East along the east boundary of said SE % NW % a distance of 1326.85 feet to the southeast corner of said SE % NW %; thence South 89" 48' 28" West along the south boundary of said SE % NW'/ a distance of 845.42 feet to a point on the centerline of the United States Solomon Drain which lies 1806.11 feet east of the southwest corner of the SW % NW %; thence traversing said centerline as follows: North 23 36' 12" West a distance of 900.59 feet; along a curve to the right having a central angle of 10 a radius of 1200.00 feet, an arc length of 221.90 feet and a long chord which bears North 18° 18' 18" West a distance of 221.59 ■ .��._ _ .I'm ---: I I ]L� T, 77 tt - - - - - - - - - 5 . . . . . . . . . . ...... - ALLI 7 ITTr-- 7 Pl - W 1-2 ..
