ORDINANCE NO. 2515
AN ORDINANCE TO PROVIDE A C -2 (COMMUNITY COMMERCIAL) ZONE DESIGNATION FOR
CERTAIN LANDS; DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST OF THE CITY
OF CALDWELL, IDAHO; INSTRUCTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT
DIRECTOR TO DESIGNATE SAID PROPERTY AS C -2 ON THE OFFICIAL ZONING MAP AND
OTHER AREA MAPS OF THE CITY REPEALING ALL LAWS ORDINANCES AND RESOLUTIONS IN
CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY
OF CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell upon recommendation of
the Caldwell Planning and Zoning Commission that Case No. ZON- 38 -04, a request by Caldwell East
Urban Renewal to rezone certain property, and following the public notice and hearing procedures as
required by Idaho Code, Chapter 65 Local Planning Act, that the following described property be zoned
C -2 (Community Commercial) and that said zoning designation is in the best interest of the City of
Caldwell, Idaho.
Section 1. The site is located on the east side of Smeed Park Way approximately 625 feet south of
Highway 20126. The property is inside the corporate boundaries of the City of Caldwell, and the
Applicant has requested this site to be rezoned as C -2 (Community Commercial):
A parcel of land located in the Northwest Quarter of the Northeast Quarter of Section 25, Township 4
North, Range 3 West, Boise Meridian, City of Caldwell, Canyon County, Idaho, more particularly
described as follows:
COMMENCING at the South Quarter corner of said Section 25, marked by a aluminum cap, as shown on
Record of Survey recorded as Instrument No. 200036080, on file in the office of the Canyon County
Recorder: thence North 00" 40' 13" East coincident with the West line of the Southwest Quarter of the
Southeast Quarter, a distance of 1,324.90 feet to the Northwest corner of said Southwest Quarter of the
Southeast Quarter; thence North 00° 42'09" East coincident with the West line of the Northwest Quarter
of the Southeast Quarter, a distance of 1,324.89 feet to a 518 inch rebar marking the Northwest comer of
said Northwest Quarter of the Southeast Quarter; thence North 00" 41' 22" East coincident with the West
line of the Southwest Quarter of the Northeast Quarter, a distance of 1,320.29 feet to the Northwest
corner of said Southwest Quarter of the Northeast Quarter; thence North 89" 30' 24" East coincident with
the South line of the Northwest Quarter of the Northeast Quarter a distance of 80.02 feet to the POINT
OF BEGINNING; thence North 00° 41' 22" East parallel with the West line of said Northwest Quarter of
the Northeast Quarter a distance of 190.00 feet; thence North 89 30' 24" East parallel with the South
line of said Northwest Quarter of the Northeast Quarter, a distance of 931.33 feet; thence North 00" 38'
49" East parallel with the East line of said Northwest Quarter of the Northeast Quarter a distance of
471.03 feet; thence North 89 27' 22" East, 309.00 feet to said East line of the Northwest Quarter of
the Northeast Quarter; thence South 00° 38' 49" West coincident with said East line of the Northwest
Quarter of the Northeast Quarter a distance of 661.30 feet to a 518 inch rebar P.L.S. 7732 marking the
Southeast corner of said Northwest Quarter of the Northeast Quarter; thence South 89" 30' 24" West
coincident with said South line of the Northwest Quarter of the Northeast Quarter, a distance of 1,240.47
feet to the POINT OF BEGINNING.
BASIS OF BEARINGS for this parcel is North 00 41' 22" East between a 518 inch rebar marking the
Center Quarter corner and a brass cap marking the North Quarter corner all in Section 25, Township 4
North, Range 3 West, Boise Meridian, Canyon County, Idaho.
