ORDINANCE NO. 2510
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF
THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE -
FAMILY) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR
TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission, and following the public notice and hearing procedures set forth in Section 10- 01-07, Zoning
Ordinance No. 1451, approved Case No. ANN -88-04 (Brittany Heights) at a public hearing held July 19,
2004.
Section 2. The property abuts Homedale Road to the south, is approximately 1,600 feet west of Homedale
Road and Midway Avenue intersection, and extends south to Moss Lane. The parcel is contiguous to the
City of Caldwell, Idaho and the applicant has requested that said following described property should be
annexed into the City of Caldwell as an R -1 (Single - Family Residential) zone:
A parcel of land being a portion of the NE % of Section 12, Township 3 North, Range 3 West, Boise
Meridian, Canyon County Idaho, more particularly described as follows:
Commencing at the NW comer of said NE %, (114 comer common to section 1 and 12), said comer
monumented with a found 3 inch diameter aluminum disk; Thence N. 89 25' 55" E., a distance of 164.24
feet along the northerly boundary of said NE %, to the POINT OF BEGINNING, said point monumented with
a 5/8 inch diameter iron pin; Thence continuing along the northerly boundary of said NE %, N. 89 25' 55"
E., a distance of 801.07 feet to a point on the centerline of the Elijah Drain, said point monumented with a
found 5/8 inch diameter iron pin; Thence leaving the northerly boundary of said NE % and along the
centerline of said Elijah Drain the following courses and distances; Thence S. 29 04' 06" E., a distance of
286.09 feet to a point; Thence S. 35 18'56n E., a distance of 169.78 feet to a point; Thence S. 39 29'4W
E., a distance of 150.81 feet to a point; Thence S. 45 05'20" E., a distance of 29.94 feet to a point on the
easterly boundary of the NW % NE % of said Section 12, said point witnessed S. 0 25'4(r W., a distance
of 77.09 feet with a 518 inch diameter iron pin; Thence leaving the centerline of said Elijah Drain, S. 0 25'
40" W., a distance of 131.48 feet along the easterly boundary of said NW'/ NE'/, to the NW comer of the
S % of the NE Y4 NE % of said Section 12, said comer monumented with a 5/8 inch diameter iron pin;
Thence leaving the easterly boundary of said NW % NE %, N. 89 25' 45" E., a distance of 131.56 feet
along the northerly boundary of said S Y of the NE % NE %, to a point on the centerline of said Elijah Drain,
said point witnessed S. 89 25' 45" W., a distance of 77.14 feet with a 518 inch diameter iron pin; Thence
leaving the northerly boundary of said S % of the NE % NE %, S. 45 05'2(r E., a distance of 304.92 feet
along the oentedine of said Elijah Drain, to the point of intersection of the centerline of said Elijah Drain and
the centerline of the Isaiah Drain; Thence leaving the centerline of said Elijah Drain and along the centerline
of said Isaiah Drain the following courses and distance; Thence S. 28 34' 14° W., a distance of 170.42 feet
to a point; Thence S. 26 26' 20 W., a distance of 121.50 feet to a point; Thence S. 26 35' 27° W., a

land as shown on a Record of Survey for Bob Cope, recorded in the Office of the Recorder of Canyon
County, Idaho, as Instrument No. 9322889, said comer monumented with a found PK nail, replaced with a
518 inch diameter iron pin; Thence leaving the southerly boundary of said SW % NE %, N. 22 36' 28" W., a
distance of 200.00 feet along the easterly boundary of said Record of Survey to the NE comer of said
Record of Survey said comer monumented with a found % inch diameter iron pin; Thence along the
northerly boundary of said Record of Survey, S. 89 23' 11' W., a distance of 668.62 feet, parallel with the
southerly boundary of said SW % NE %, to the NW comer of said Record of Survey, said comer
monumented with a 518 inch diameter iron pin; Thence leaving the northerly boundary of said Record of
Survey, N. 45 04' 52" W., a distance of 230.50 feet to a point on the westerly boundary of said SW % NE
'/4, said point monumented with a found 518 inch diameter iron pin; Thence along the westerly boundary of
said SW % NE %, N. 0 27' 11" E., a distance of 972.88 feet to the NW comer of said SW % NE %, (CN
1116 comer), said comer also being the SW comer of a parcel of land as shown on a Record of Survey for
Lola Nielsen, recorded in the Office of the Recorder of Canyon County, Idaho, as Instrument No. 9905955,
and is monumented with a found 518 inch diameter iron pin; Thence leaving the westerly boundary of said
SW % NE %4, N. 89 24' 57" E., a distance of 268.79 feet along the northerly boundary of said SW % NE %,
to a point on the centerline of the Stone Lateral, said point also being the SE comer of said Record of
Survey Instrument No. 9905955, and is witnessed S. 89 24' 57" W., a distance of 10.00 feet with a found
518 inch diameter iron pin; Thence along the centerline of said Stone Lateral and along the northeasterly
boundary of said Record of Survey Instrument No. 9905955 the following courses and distances; Thence N.

pin; Thence leaving the westerly boundary of said NW % NE %, N. 89° 25'55" E., a distance of 164.24 feet
parallel with the northerly boundary of said NW '/ NE '/, and along the southerly boundary of said Record
of Survey Instrument No. 200324201, to a 518 inch diameter iron pin; Thence N. 0° 27' 11" E., a distance of
378.04 feet parallel with the westerly boundary of said NW '/4 NE % to the POINT OF BEGINNING. This
parcel contains 74.05 acres more or less.
Section 3. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell, Idaho as an R -1 (SingWFamily Residential) zone.
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
