HomeMy WebLinkAboutORD 2497r 0 BILL NO. 11 ORDINANCE NO. 2497 AN ORDINANCE TO AMEND CHAPTER 11, OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, REGARDING: AMENDMENTS TO ARTICLE 1, SECTION 11- 01 -04, DEFINITIONS, BY ADDING LANGUAGE UNDER SUBSECTION 2 OF THE DEFINITION OF "SUBDIVISION "; AND BY ADDING A DEFINITION FOR A "BUILDABLE ". REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. Adding certain language as follows shall amend that Article 1, Section 11- 01 -04, Definitions subsection (2) under "Subdivision ": (2) The dedicating of any street or alley through or along any tract of land. A land division created by a public aaencv to accommodate a public purpose that is incidental to the interests of the property owner whose land was involved in the transaction shall be exempt from the subdivision process, provided the public acquired land does not meet the buildable threshold. Section 2. Adding certain language as follows shall amend that Article 1, Section 11- 01 -04, Definitions creating a definition for "Buildable ". BUILDABLE: A buildable tract, lot or parcel is one that is eligible for a building permit to construct some habitable structure - after agency review and relying upon all adopted Cily standards for that assessment. Section 3. Modifying certain language as follows that shall amend that Article 1, Section 11- 01 -04, Definitions, under "Subdivision ": Subdivision: The dividing of land into ^^^•^ than "•• ^''" two or more buildable tracts, lots, or parcels for the transfer of ownership or for the construction of improvements on the buildable tracts, lots, or parcels thffeen. Division of a lot, tract or parcel of land that occurs incidental to the creation of a Manufacture Home Development, as defined under this Article or the dedication of roadways within the development tharein, shall not be subject to the Art+sle 2, platting procedures requirements associated with Article 2. For the purpose of this Article, "subdivision" shall mean and include the following: (1) The dividing of land into m^F^ t "^^ tW8 2 two or more buildable tracts, lots, or parcels for the transfer of ownership or building development, any part of which, when subdivided, contains less than five (5) acres. (3) The resubdivision of a lot, tract or parcel ' except as provided below: A. The a- readjustment of lot lines as shown on a recorded plat, which does not reduce the area, frontage, width, or depth of each building site below the minimum prescribed by any City ordinance.
